Need help. Wife ng Brother ko may kalaguyo at gusto namin sila makulong!

Sobrang stress na ko. ang hirap pag malayo ka sa family mo. One day nagpunta mother ko sa house ng sis-in-law ko pero nasa work ang brother ko so pag akyat ng mother ko sa room may lalake at tinanong nya kung cno yung lalake ang sagot ng lalake friend daw sya ng hipag ko so hindi naniwala mama ko dahil may asawang tao sya tpos magpapa akyat ng frend sa rum nila at take note lalake pa.

Tinanong ng mama ko ang hipag ko at iba nmn sagot nya, anak daw ng step brother nya so diskumpyansa tlaga mother ko kaya umalis na lang sya. Ngayon hindi namin sinabi sa kapatid ko dahil baka magpakamatay pero tadhana na ang gumawa ng way nag text ung lalake at nabasa ng brother ko ngyon napaamin ung asawa nya.sa amin na ngyon nakatira ang brother ko at tuluyan sila naghiwalay.

Ngyon po gusto namin makuha ung pamangkin ko sa hipag ko kasi wla sya work, at kung magbibigay man ako ng sustento sa pamangkin ko baka gastusin lang ng hipag ko sa kabet nya. nababalitaan namin lagi andun sa knila ung lalake at patago nyang dinadala sa bahay nila at mismong anak nya ang nakakakita. At alam ng mga kamag anak at neighbor nya ung ginagawa nyang immoral. Ano po ba ang dapat gawin? sabi kc sa barangay kelangan ng evidence para masampahan nmin cla ng kaso. Gustong gusto ko kunin ang pamangkin ko dahil ako rin ang nagsusuporta dun khit may work naman ang brother ko. thanks po sana mabgyan nyo ko ng legal advice.

Your brother may sue his wife, for adultery (if he has proof).

FYI, Only the offended spouse, and nobody else can legally file the complaint for adultery as this is a private crime.  There is no provision for the prosecution of the crime of adultery  by the parents, or any family members of the offended party.

tnx for ur prompt response. actually hindi nman ako ang magpa file ng case against my sis-in-law. just want to help my brother coz he dont know how and where to start. sobrang depress na sya. and about proof hindi pa ba enough yung buong barangay nila alam ang ginawa nyang kabaliwan. and nahuli na sila ng mother ko kaya lang hindi nya kasi nakunan ng picture nawala na sa isip nya.

Your brother can start by finding a lawyer even from PAO to help him prepare his Complaint-Affidavit and the Affidavit of his Witnesses (like your mother, neighbors, etc.) and any other evidence available. He should do this if he is ready to have his wife and her lover go to prison (if proven guilty in court).

Thank u so much Ms katrina. my brother really wants his wife to go to jail and her lover as well and we wants to get the custody of my brother's daughter.

You're welcome. If your sister-in-law gets imprisoned, the child will automatically be under your brother's custody. Besides, given that they are married, your brother has joint custody over their child.

Were really having a hard time to get some evidence to prove that my bother's wife is committing adultery. Alam mo yun kahit alam na ng buong mundo yung ginagwa nyang kataksilan hindi pa rin enough para pagbayaran nya yung immoral nyang gawain. Kelngan pa ba makunan sa akto? Kahit di na sila makulong sana basta makuha lng ng brother ko yung daughter nya. Kaya lng ayaw ibigay samen yung bata which is nakakaawa kasi ako ang nagpapaaral dun and now stop ako sa pagbigay ng allowance sa bata dahil wala na ako tiwala sa sis-in-law ko.

ask ko lang po sa mga respected lawyers dito. Need daw kasi namin ng evidence para makapag file ang brother ko ng adultery against his wife. Sa totoo lang nahihirapan kami kasi hindi nman 24 oras mababantayan namin hipag ko and medyo malayo bahay nya samen.

Plan namin medyo magpalamig muna at antayin na magsama sa isang bubong ung wife ng brother ko at ang bagong boyfriend nito. nang sa ganun malakas na ang evidence namin. Tama ba yung gagawin namin?pls give us advice nman po. thanks

No, kasal sila so sa Father ang punta ng bata. Sa kasal na mag-asawa, hanggat may nabubuhay sa isa sa mga mga magulang ng bata, hindi maaring mag-assume ng parental authority ang mga grandparents or ibang relatives. and If ever na wala na ang parehong magulang the grandparents may assume pero maari itong bawiin ng korte at ibigay sa iba. The court will decide kung saan masmapapaganda ang kalagayan ng bata.

Mas magiging malakas ang kaso kung mahuhuli sa akto or may maipapakita ka na picture. But sometime the court is considering testimonies from witnesses, you just need to make sure that you can prove it beyond reasonable doubt.
