sir, tanong kulang po kong convicted ka ng slight physical injury at binigyan ka ng 15 days for pleading o mag apply ng probation at na late ka ng pag file ng papers, ano po ba magiging problema. pero first offend mo lang ang kaso na ito.

if you did not file anything, then the sentence is final and you no longer have any chance for appeal. talk to your pao lawyer regarding probation or just serve out the sentence.

sa kaso ito ng friend ko, na ospital yong abogado niya dahil sa stroke at hanggang ngaun ay nasa ICU pa, at malapit na ang deadline ng submission para sa application ng probation, maari po ba magpalit kaagad ng abogado para makagawa kaagad ng application for probation na mai submit sa korte, may consideration ba ang korte sa case na ito.

pag convicted ka ng slight physical injury at may pinapabayaran na moral damages cost. Ang abogado ay nag file ng Motion for reconsideration don sa moral damages dahil hindi daw na prove sa court, magkakaroon ba ng problema sa application for probation, dahil nauna na nafile yong motion for reconsideration para sa moral damages ng convicted. Ano na ang pwedeng mangyari d2, at pag halimbawa na grant ng korte yong motion for reconsideration, maaari pa bang mag file ng probation para don sa criminal liability ng convicetd person.

interesting question, and i could not find a definite answer. a partial MR covers only the portion which is being asked to be reconsidered. it is technically not an appeal of the conviction per se.

the rule is if you file for probation, your appeal is deemed withdrawn.

if you already file an application for probation for the slight physical injury you have been convicted, ano na po ba ang susunod na gagawin o mangyayari.suspended na ba yong sentence na binigay sa yo temporarily?
