magtatanong lang po sana.
may habol po ba sa separation pay ang isang empleyado na limang taon na sa kompanya kahit na contractual lang? yearly po sya magsign ng contract. wala po kasi nakasulat sa kontrata about separation pay or back pay man lang.

Bawal yang ginagawa nila. After 1 year ng trabaho, automatic regular na ang status and would be entitled to benefits stated in the labor code kahit papirmahin pa sila mg contract. Masasabing contractual lang ang trabaho if after ng term ng contract, di na i-rerehire. Constant rehiring connotes the usefulness of the service to the company, thus entitles the employee to a regular status. So, entitled ka sa separation pay and kung anu-ano pang benefits. If after ng resignation mo, magsisimula ng magcount ang 3-year period na dapat igiit mo ang karapatan mo o money claims. After 3 years, wala na. Prescribed na. Ibig sabihin, nawala na ang karapatan mong igiit ang right mo.

Ako din po ganyan ang sitwasyon. 3years na ako sa kumpanya. kung entitled sa separation pay ang katulad nya, matatawag po ba sya na Regular Employee dahil sa tagal nya?

ako po kase 3years na pero 'on call lang po ang trabaho ko. pero 3 times na po ako pumirma ng contract. may habol po ba ako maregular?
