Hi Everyone,

Thank you in advance para sa mga idea at maitutulong ninyo.

The scenario is:

Nabyudo ang papa ko sa first wife nya ng year 1983. - Nakilala nya yung mother ko year 1989, nag sama pero hindi pa sila nag pakasal.

Pinanganak ako ng 1990. - since hindi pa kasal ang parents ko during this time, surname ng mama ko yung nilagay sa birth certificate ko.

Elementary until College - surname ng father ko yung ginamit ko sa school records until sa work.

Year 2004, nag pakasal ang mama at papa ko.

Year 2013, namatay yung father ko. Pero hindi pa din nila nalalakad yung legitimation ko.

Year 2015, need kong kumuha ng passport, unfortunately, isa sa requirement is yung NSO birth certificate.

Sa NSO birth certificate ko po, Surname ng mama ko yung nakalagay.

Then nilalakad ko po ung legitimation ko sa City Hall ng Manila, pero nag hahanap sila ng authentic writing ng father ko na nagpapatunay na pinanagutan nya ako bilang isang anak, which is hindi ko na maiprovide dahil wala na sya.

I was told to seek advise from a lawyer. Sabi nung nakausap ko sa legal office, magkakaron pa daw po ng hearing etc. Then pag may papers na na nag uutos sa kanilang baguhin yung records ko, saka lang nila mababago ito.

P.S. I have the following documents, cenomar pra sa dlwang kasal ng father ko. Death certificate ng first wife ng father ko, death certificate ng father ko, baptismal record, school records, birth certificate ko, marriage certificate ng father ko sa first wife, marriage certificate ng parents ko, birth certificate ng sister ko.

Question ko po ay:

1. Any advise based from your own experience/ or expertise kung ano pong dapat kung gawin for the legitimation process. Ano po ung papel na kelangan ko na sa tingin nyu po ay tatanggapin ng legal office ng city hall? Tulad po nung mga affidavit that was duly signed by a lawyer.

2. Any advise po kung paano ako makakakuha ng passport without authentic NSO copy of birth certificate. Yung mga documents or affidavit na tatanggapin sa DFA para ma issue-han po ako ng passport.

In your birth certificate, did your father signed? if yes, that is tantamount to acknowledgement of your father and can be used in court as proof that you are an acknowledge child of your father. Better go to court asap, because only the court of competent jurisdiction can compel the civil registrar and nso to change your birth certificate

Hello sir,

No, there is no signature on my birth certificate. Ang nakalagay po sa father section is N/A. Yung mother ko lang po ang nakalgay sa birth certificate.

Meron po akong report card w/ sign ng father ko; Phili health record kung san nakalagay ako as benefeciary ng father ko at baptismal record na nakalagay ang name ng father ko.

Will this be enough for legitimation process?

Before going through the court proceeding which is correct, try to see if submitting an affidavit to use the surname of the father signed by the mother with documented support can suffice. Use documents that you have which shows your connection with your father such as your Philhealth, baptismal certificate. Look for others such as report cards with father’s signature etc.
If not, you really have to file for a petition in court.

If in your baptismal certificate appears the signature of your father, that is the same effect of birth certificate signed by your father

Hello Sir, I went to the City Hall once again yesterday and talk to different personnel in Legal section. Fortunately, I was told that my documents will suffice without proceeding on the court. So currently, I was gathering all the requirements and will be back on Tuesday to proceed with the legitimation process. However, it will take 1 to 1 1/2 months to be processed according to them. Hopefully, this will be okay now. Thank you!

Hello Sir, unfortunately, there is no signature on the Baptismal but my fathers name was indicated on there.

My next question is, is there an affidavit that is being accepted in DFA wherein stating that my legitimation process is currently on process in the civil registrar? I understand that SECPA is being accepted on DFA but this will take me 1 1/2 at max before receiving one from City Hall which I think will be a problem as I have to get a passport ASAP for working purposes.

Congratulations! Salamat naman at narecognize ang processo. Do not expect a change in surname on the updated Certificate of Live Birth. It will just be an annotation at the sides or at the back. To speed up securing the NSO validated CLB after the Office of Civil Registry updates your record, there is an official step. Saka na muna iyon.

Kung ksama mo pa ung father mo, madali lang ung process and I dont think kelangan mo ng attorney regarding this.

Let me know if my understanding is correct.

Hi jurell! The problem is kelngan ata ng court hearing ksi kasal si mother sa una, tpos kasal sya sa father ko. Ang advice nung attorney nakausap namin para ma annotate ubg name ko is papa cancel ung legitimation ko kso my affidavit of acknowledgement na ako sa LCR (Live Borth certificate) ever since pla meron na tpos nka register na ubg name ko sa NSO the problema is ayaw nila ilabaa NSO ko ksi maarried si mother so ang mangyayari mag ffile ako petition for cancelatio of legitimation ksi void pdn ksal ng mama at papa ko. Gs2 ko mlaman ganu ktgal sana aabutin ng attorney or court hearing kung mablis ba sana? Ksi urgent emergency ksi kya need ko birthcertificate. Tska if magkano mga mgagastos. Any idea?
