hello,
Please help and thank you in advance.
We are trying to sell a property of my deceased mom but the only legal document we have is tax declaration under her name. however we recently discovered that the original rights still belongs to my deceased grandpa leaving no will and testament to two living children. Questions:
1. Who is the rightful owner of the property?
2. Do we have the right as children of my deceased mom to sell the property?

if the tax dec is in your mother's name, then what you should do is to settle her estate by executing an extra judicial settlement plus pay taxes. after which the provincial assessor should allow you to transfer the tax dec.

what document shows that your grandfather originally had the rights to the property? if it's a tax dec also, then it should have been canceled when your mother's was issued.
