Okay. I did a little research about the charges filed for my father. RA 9165 section 5, and 11.

What he basically did was stop at the place where they are supposed to meet with the pusher. Then, he was stopped by two police officers, went to inspect without the a Barangay official witnessing. Dragged him to the place of the pusher and took photos of him took from the place of the pusher, with the evidence the police took from the pusher. My father and the pusher were charged with RA 9165 section 5, and 11 but why did they grant bail on the pusher? The place where he was stopped were in between buildings so CCTV cameras should be present? If I am able to get a video in on of these CCTV's showing that it was not a buy bust and that the original buy bust was this pusher, do we have a strong case against the arresting officers? Whats the next best step?

Hi, parehas tayo ng situation ngayon. Ung asawa ko din RA 9165 section 5 & 11 ang kaso nya.

Gusto ko sana malaman kaya nagawi ako sa site na ito kung paano ba masasabi na HINDI strong ang evidence ng mga witnesses na pulis para ma-grant yung bail ng husband ko? Actually noong time na dinampot ang asawa ko walang nakuha sa kanya na item or shabu kahit pera wala din. Yung 2 pulis na naka civillian pag kapara sa sasakyan ni hubby hinalughog ang sasakyan nun isang pulis, habang yung isang pulis nakabantay sa asawa ko, nakatutok ang baril. Walang search warrant kasi after ng inquest ni hubby nalaman na lang namin na buy bust yung kaso nya. At no bail pa. So ayun after maghalughog sa sasakyan at walang nakita dinala sya sa headquarters, gamit yung sasakyan namin at yung isang pulis ang amg nag drive, while yung isang pulis naka kotse, convoy sila. After nila sa headquarters less than an hour daw according to hubby bumalik sila sa barangay na pipnag parahan sa kanya ng sasakyan at dinala sya sa barangay hall don at pag dating sa barangay hall don may na-i-present na yung mga pulis na 2 sachet of shabu and marked money na 500. According to hubby din pala kaya naghintay sila sa headquarter ng ganun kasi hinintay nila yung DOJ representative, at yung isang pulis na tumayong witness ni hubby na syang may dala ng item. Technically yung isang pulis na pumara kay hubby na syang naghahalughog sa sasakyan ay hindi tumayong witness ipinasa nya na lang don sa isa na may dalang item.

Sa resolution paper ni hubby may posuer buyer daw, pero totoo wala naman...
Just wanna know after pre-trial ano po ang next? Meron po kasi motion for bail. And usually ilang hearing po before ma-grant ang bail?
