*****agreed date to pay debt not honored*****

hi attorneys,

i previously filed a complaint against my ex officemate at her barangay's lupon in dumaguete city for non-payment of debt. the debt was incurred at our workplace, by the way. . .
the debt was due last sep 10,2010. but we've reached an amicable settlement for her to pay the debt last november 30. that's because she got no job yet when conciliation was done at her barangay last september.
she has not honored her obligation yet.
the problem is she is now working in cebu.
she has a stable source of income now and has no reason not to pay her debt as we have agreed.
what action should i take now?
i think it is not feasible to bring about the case to her barangay's lupon since she is not residing in dumaguete anymore.
can i go ahead and bring this matter to the small claims court?
or should I still bring the matter to her barangay's lupon and secure a certificate to file a case?

i believe your first step should be to send her a demand letter to perform her obligation. only if she fails to respond should you file a complaint at the small claims court for enforcement. there is no need for a further certification from the lupon. good luck.
