Hi Team -

I would be needing your expertise as my agent will go to an admin hearing this week.

With his NTE, he said that the reason why he did those call avoidance is because he is demotivated because of me. He included the past experiences of his colleagues that is very exaggerated not understanding the true story behind those, but he is not the one affected before.

With those issues, can he take those against me and is it appropriate to use those even that is not relating to his case?

Not related issues therefore cannot be used.

Always stick to the issue even if he says you are the reason. Still, he knows it's wrong therefore proper sanctions are in order.

If he has any concerns about you then he should make his complaint to your manager for proper documentation.

His case will be heard as a matter of procedure.

I doubt that he will win - he did something wrong, and assuming that you are the reason for it, that does not make it right.

How about this, call avoidance but the employee is pregnant. In her explanation letter, she said that is because of hormonal in-balance but during the coaching she admitted and she said that she want to take some rest.

Unlikely possible - she will have to prove that the imbalance is the cause.

If during the coaching, what she said is documented then that can be used as evidence.

If her condition warranted a rest period then she could have requested to go to the clinic.
