Hi Im a newbie here. I have been bothered in the last few days trying to seek legal advise about my marriage. My estranged husband and I got married in 2002, had a child the same year, but we separated in 2005 due to what I believe is infidelity. (He asked for his freedom.)

He did not communicate with us since then. Now we both have our own partners. He has 2 kids and I have my own too. I don't know where to contact him and his whereabouts so in 2011 I messaged him in facebook. He was active in fb so I knew that he read my message, but he did not reply. I did not try to message him again until early this week, but it was his new partner that replied claiming herself to be the legal wife, and saying that I am only after the child support or maybe wants to get him back. I never asked for child support in that 10 yaers, all Im asking is to move on legally and remove his last name with my name.

With that kind of message from the "new wife" it makes me think that my ex-husband married her too after we separated. (they are together only for 6 years now, based on a facebook post).

All these years, I've been enduring the mistake of marrying him. I have a partner now and we cannot marry since I'm still married with my ex, but based on his "new wife's" reply. it makes me think that she does not know he was married with me first, and that they got married too. What can I do? I want out marriage contract to be null and void since we both have our own separate lives now.

Sorry for the long description. I only wanted to make it detailed. I will appreciate the reply. Thaks so much!

kumuha ng Cenomar, at kung married sya uli, lalabas dito yon.
2. if totots, then pwede mo ihabla ng bigamy.
3. them being married while hubby still married to you, made theirs void and null,
but, this is not aground for annuling your marriage.

for references on the grounds of annulment, check the family code...
article 35 to 54 , readily available on the net..

Depending on the other circumstances surrounding your marriage (when you were still together), the only possible legal remedy to put an end to your marriage is psychological incapacity of either of the two of you.

Psychological incapacity refers to the performance of essential marital obligations of the spouses to each other and to the children. This can be manifested by the inability to give love, support, care, understanding, etc. due to some psychological defect/incapacity.
