Hello! I'm desperate for legal advice but still reluctant to go to NLRC since I'm not sure if this issue of mine is substantive.

Here it goes...

I just resigned from my post as a copy editor in a publishing company here in Cebu. It's an American company that set up an office here in the Philippines. Every month, we're assigned to edit three hundred thousand words of manuscripts regardless if we've finish the previous workload or not. (The number of manuscripts/books we edit there varies, depending on the total number of words.) Thus, we're in a vicious cycle of the inability to get the work done on time because they throw another batch on us once another month starts.

My termination date was last May 14. As you would've expect, I was unable to finish my April workload. This morning, my supervisor told me the HR would not process my exit clearance unless those manuscripts are edited are submitted. So my last pay will most likely be compromised.

Is that all right? Am I still liable to them even if I'm no longer working there? I read our code of conduct thoroughly but didn't see anything pertaining to this.

did you gave them a 30 day notice?
you should be using these 30 days to finish all your tasks, turnover responsibilities to others, among others duties.

Once done, you should be able to get exit clearance COE, all pays,, etc..

pumapasok ka pa ba?
if hindi na at COE lang problema mo, then bargain that you will do them pero dapat bayaran ka nila sa oras na nagtrabaho ka.

Thanks for responding. Yes, I gave them thirty days notice po. I submitted my resignation letter last April 14. Kaso nga po, dahil patong-patong ang mga manuscripts na assigned sa akin, di ko po ito natapos before my last day sa work. Nagtanong po ako sa dati kong kasamahan na nauna sa akin mag resign. Nakapagtataka lang po na siya di na ginanito, as in di na po siya hinabol ng kumpanya kahit na di nya rin natapos yung work. Samantalang mas madami po ang din ya natapos. Sa totoo lang marami po talaga sa amin ang umalis dahil sa gulo ng management. Natimingan yata ako at nasampolan. Ang unfair lang po ng konti. Sad

Para sagutin po yung tanong nyo sa taas. Di na po ako pumapasok. Ang last day ko po is nung May 14 pa. Di po ba akong masyadong imposing if makipag bargain ako na bayaran nila?

meron naunang nagpost dito regarding unfair practice ng employer sa mga employees,
medyo related,

sa case mo, required cla magbigay ng COE.. at di mo na rin matatapos since di ka na pumapasok,,
nag file ba cla ng case?

Di ko po nahanap yung related na post. Maybe I used the wrong keywords. Yun na nga po eh, paano ko po matatapos yung work kung di na ako pinapapasok sa loob ng opisina in the first place. Hanggang dun lang ako sa reception area. Wala naman pong case. Nag text lang po yung supervisor ko na ganun nga di daw mapa-process yung exit clearance unless ma-submit lahat ng naiwan kong manuscripts.

Thank you for the link. Last na tanong ko na po ito. To sum up, ang dapat ko pong gawin ay sabihin na

1. di ko na matatapos yung remaining work dahil di na ako pumapasok at di na nila ako empleyado,
2. willing akong tapusin yun given na babayaran nila ako.
