Hi,

My daughter is with me for 7 years, she is also 7 years old.

I am the one working for her. But I discovered that her mother is using her as a dependent for the tax exemption and dont want to give me the waiver to use the tax exemption.

What can I do regarding this? I and my daughters mother are not married and we separated ways since when my daughter is less that a year old.

since di kayo kasal, ano surname ng bata sa BC ? acknowledged mo b sya?
ano kasunduan nyo,
child <7, sa nanay ang custody ng bata.
now 7 n sya, pero yun nga, dapat meron kang legal papers to prove anak mo sya..

Lastname ko gamit ng daughter ko. Signed ko Birth Certificate niya. iniwan sakin ang daughter ko less than a year.

medyo nasa other stick of the bargain tayo,,
meron kasing protection against women and their children, pero walang protection against men and their children ;(

punta n lang tayo sa article 327 chapter 4 of New civil code..
basahin mo to, eto grounds na nakikita kong bala mo..

Personal Exemptions:

For single individual or married individual judicially decreed as legally separated with no qualified dependents………………………………………P 50,000.00

For head of family……………………………P 50,000.00

For each married individual *…………P 50,000.00

Note: In case of married individuals where only one of the spouses is deriving gross income, only such spouse will be allowed to claim the personal exemption.

Additional Exemptions:

For each qualified dependent, an P25,000 additional exemption can be claimed but only up to 4 qualified dependents

The additional exemption can be claimed by the following:

1.The husband who is deemed the head of the family unless he explicitly waives his right in favor of his wife

2.The spouse who has custody of the child or children in case of legally separated spouses. Provided, that the total amount of additional exemptions that may be claimed by both shall not exceed the maximum additional exemptions allowed by the Tax Code.

3.The individuals considered as Head of the Family supporting a qualified dependent

since ikaw ang me custody sa bata,
pwede tayo punta sa adoption...
once adopted na c baby, magiging Legitimated na sya,,, at wala nang right c mother,, yun nga lang, need mo approval ni mother dito,
pero,, since inabandona nya kayo long time ago, pwede mo ground to sa suspension/termination of parental authority ni mother, which is true naman na iniwan nya kayo.
medyo konting paikot lang para naman sa good adan, kasi laging argabyado sa forums dito eh mga eba....

kasi wala syang suporta, financial, etc..
basahin yong rights ng children under the family code, at yong joined duties ng parents..
marami don di nya nagagawa?
anong waiver, sa adaption?
need na sign na payag sya, as in sya ang mother,..
requirement yon..
kung sa tax lang, nasa custody mo ang bata, ikaw ang nagsusuport, so ang right for exemption eh sayo hindi ke mother,,
ang default kasi he <7 na kay mother c baby, pero 7 na sya now, pwede na sya pumili,,,

this is getting too far.. what is the bottomline of this? tax exemption lang ba? theres no such thing now as illegitimate or legitimate child para sa tax exemption and even sa iba pang rights bilang anak. pakibasa ng malinaw ang tax code regarding additional exemption for qualified depedents.

"DEPENDENT CHILD means a legitimate, illegitimate or LEGALLY ADOPTED CHILD chiefly dependent upon and living with the taxpayer if such dependent is not more than 21 years of age, unmarried and not gainfully employed or if such dependent, regardless of age, is incapable of self-support because of mental or physical defect"

Last question ko po. Do I need a waiver signed by her na ako ang gagamit ng tax exemption para sa anak ko or hindi na? Kasi hinihingan ako ng hr nmn kasi ndi raw kami married.

Yes this year. Sa august 6 pa po xa mag 7.

Nag claim po ako last year. Pero ngaun ko lng nalaman na nagclaim din pala ung mother since employment nia i think more than 4 years ago.

e sa ngaun wala na ba work ung mother? kung ikaw na lang ang my work sa inyo sa ngaun, kahit na siya ang dating nagclaim, ikaw na talaga ang rightful claimant. tsaka nasayo na ang custody ng bata kasi, it means ikaw ang gumagastos sa daily living expenses nya, un ang purpose bakit meron tax exemption pra sa dependent. if u can get a letter/waiver from the mother, might as well get it na para lang sa request ng HR nyo. or talk to the company's tax accountant pra i-assist ka.

talk to ur HR or to your Finance dept,,latag mo case mo, as per above ikaw ang dapat me claim.
then talk to the mother, latag mo rin case mo, na ikaw ang custody kaya dapat sayo ang exemption.
if ayaw nya, hingi ka ng share nya sa financial,,
if ayaw pa rin, then maraming ways, as i have suggested above..

ganito kasi ang rule. tatay ang proper claimant ng tax exemption unless he makes a waiver in favor of the mother. so nagbgay ka ba ng waiver noon kya nakapag claim xa? as far as i know every year bnbgay ang waiver sa mother kung gusto nya makapagclaim xa. so kung wla nman hawak na waiver si mother no questions ask ikaw tlga ang mgclaim nun. kulang ata sa proper info ang HR nyo

ask lang po. what if me and my husband working together in the same company and may isang anak po kami, yung exemption ba na 25k sa dependent namin ay maaaply lang sa asawa ko? thanks po.

yes. automatically sa knya.. isa lang ang pwde mgclaim sa inyong dlawa. kung gusto mo na ikaw makapag claim, kelangan ng waiver from your husband.
