Arresto Mayor

I signed the contract yesterday and it says there that I am an exempt employee though I am not part of the managerial, I am not a supervisor. It is stated there my position and followed by "an exempt position". This position is for regular post and the salary is monthly basis.

I asked the HR why it is an exempt position, first answer is that it was the instruction given to her. I asked again and she answered that they have a bracketing in salary and I was already in the bracket of supervisor and other managerial positions.

Is this Legal? Can they really base t on my salary?

They told me that I wont be having night differential pay incase I will work on night.

I ask them that I wont sign it yesterday and sign it on thursday but they told me that I cannot start unless I signed it yesterday. So, I already signed the contract.

Are you required to work at night? Or have variable working hours?

Not sure but they said that I will be on a shifting schedule and it is possible for me to work at night.

Generally the provisions on night shift differential apply to all employees except:


  • government employees

    employees of retail and service establishments regularly employing not more than 5 workers

    domestic helpers and persons in the personal service of another

    managerial employees

    field personnel and those whose time and performance are unsupervised by the employer

It might be possible to be in a supervisory level but not be a supervisor in position.
