Good day po ung car ko nabangga tapos may police report na na kasalanan ng taong nakabanagaga sakin inattentive ngaun po cnagot na ng insurance po niya kaso lng po makihati cya sakin ngaun di niya ibigay kung di ako papayag kasi di niya e prima sa insurance conpany para po e claim mag file po ako ng kaso mababayaran ba niya ako sa nagastos ko sa car ko po? at kung mag file ako ano ang action para sakanya po? pinipirwisyo niya ako kasi. di nmn niya pera un sa insurance bakit makihati pa sya ang laki ng gastos ko mabigat ba pagbasihan sa kaso ung sa police report kung magfile ako ng case? tnx po

write to him and reject his demand for a part of the insurance payment. tell him you will file a complaint of imprudence. you have to be prepared to follow up with your threat.

Good day. It's nice to see that there is a website where I could ask for free assistance regarding certain legal matters. Anyway, my friend got into an accident and unfortunately the person he ran into died. He was so afraid because the person who died is a maid of a rich personality in their subdivision and they dont want to go through settlement. They couldnt talk to the family of the deceased because the "amo" doesnt want them to settle the case. He submitted himself to the police just so they know that he did not mean it to happen and it was really an accident. He is an OFW and was just in the country for vacation. His lawyer advised him that even before the case be raffled, he needs to go back to the country where he is working. Will he be deported back and go to jail if that is the case? He is so afraid because he is thinking of his family. What if the family doesnt want to settle, what will happen to him? What should he do? Further, there's this Col. Brillantes, whom they've asked for helped, extorting them. He is asking for 200k to help settle the case. When he said Ok, but he needs to see that it be given to the family and there should be a document, the wind changed and now he said he will have him deported back in the Philippines because he has a lot of connections. He has added to my friends problem. Hope you could help us on this matter. I will truly appreciate this. Thanks and God bless

vainy, i'm afraid that unless your friend posts here that he believes his attorney has been negligent, we are constrained from giving legal advice. he should bring these matters to him.

but here's a point: even if he were convicted, he can request for probation and he does not have to serve imprisonment.

Thank you for your response. Will he be deported in the Philippines if he has a case like this? Will he still be allowed to work outside of the country if he is in probation? Because he's thinking of his family, he's the breadwinner and if he will be deported back home, then what will happen to them. Hoping for you response.. Thank you again.. God bless..
