I was married last 1997 but we have been separated for almost 12 years now and we had no further communication. I just recently learned or rather confirmed that the surname that i am using which is "andulan" is not legal eversince i already have a hard time getting a birth cert from NSO for it wasnt registered.But when i got married i used the "andulan" . i learned from city hall in malabon that my surname was registered as "bonifacio" . my question is, is my marrieage null and void because of the legality of my true identity on my birth cert?

No, your marriage is still valid. It's just that the information in your marriage contract needs correction.

How were you able to apply for a marriage license if you did not submit a birth certificate?

There was no marriage license happened. It was like someone knows a lawyer who worked at the municipality in zamboanga city..and we just got married..

Thanks for the additional information. Kung wala nga talaga kayong marriage noong ikinasal kayo, walang bisa ang kasal ninyo pero kailangan ipadeklara sa korte na walang bisa. Ito ay tinatawag na Petition for Declaration of Nullity of Marriage.

Kung walang marriage license, hindi naman ibig sabihin noon ay illegal. ANg ibig sabihin walang bisa ang kasal ninyo. Pero hindi ka pwedeng magpakasal ng basta basta, kailangan mo muna ipadeklara sa korte na walang bisa ang kasal ninyo.
