Hi!

i would like to ask if there are any guiding laws regarding the deduction of tardiness and absences on bonuses. In our school, tardiness and absences are already being deducted from the monthly salary, and annually it is also being deducted from our 13th month pays and Mid-year bonuses. Crying or Very sad

All in all, we are suffering the burden of deductions three times a year. Is this even legal?? Thanks!

Yes - a pro-rated deduction is allowed to be deducted from any bonus, including 13th month pay, if it is based on that salary earned by the employee.

The revised guidelines of the 13th month pay law (c 1986) provide that:

The minimum 13th month pay required by law shall not be less than one-twelfth of the total basic salary earned by an employee within a calendar year.

So since hindi naman actually buo ang nakukuha mong sweldo dahil sa absences and tardiness, the 13th month pay is based on the actual salary earned.

Medyo tedious lang ito i-compute pero pwedeng mangyari.
