Good afternoon ask ko lang po kung case po ba ito ng Non-diminution of benefits. Last year kase nag pass ng memo ang office namin na di na pwede i convert to cash ang unused Vl namin and since from the start of my employment kino convert naman nila ang unused VL to cash. Thank you!

IMO di naman diminution since ang benefit na VL ay di nawala - iba lang ang paraan ng pag gamit.

It depends if such benefits has ripen as a company practice which will result as a right by an employee. Let's say the VL monetary conversion has been in practice for more than 3 years and is a voluntary employer practice then they cannot be arbitrarily removed by the employer. You may lodge a complain in the NLRC if that is the case.

You may refer to a SC decision under GR 170736.
