Donation without deed of donation

Gusto ko lang po sana mag-inquire. Kasi po may donated lot sa amin intended for use as public school. Ngayon po nadonate po iyon noong 1940's or 1950's pa. Sa pagkakaalam po namin oral lang ang donation.

Tapos po namatay ang may-ari. Wala pong mga heirs na nagclaim noong donated lot na iyon for 40 years. Tapos may acknowledgement naginawa ang mga tagapagmana na yuung lot na iyon ay dinonate para maging school. Lahat po maliban sa isa ang pumirma.

Then dumating po yung isang hindi pumirma at sinabi niya pong kukunin niya yung lupa na intended for school dahil kanya daw po iyon. Tanong ko lang po. Without a deed of donation and only an acknowledgement letter from heirs..maaari pa po bang mabawi nung nagca-claim na may ari yung lot na iyon. Provided na halos 50 yrs na pong mahigit yung school lot na yun ginagamit? It would be really helpful if someone will reply ASAP..thanks

May titulo ba yung lupa?

Meron po..yung titulo po nakapangalan pa sa nagdonate...then namatay na po iyon...tapos ang nagmana po yung mga anak niya...

Hi, void po yung donation kasi under the Civil Code of the Phiippines, the donation of real property by the donor must be in writing and must be accepted (in writing) by the donee (in this  case yung public school).

The reason I asked if the property has a title was that, even if the public school was in possession of the property for 40 years, such possession cannot ripen into ownership.

Unfortunately, hindi po valid yung donation. Pero may solution naman diyan, yung mga heirs na payag sa donation, they can execute a Deed of Donation in favour of the public school. However, yung heir na ayaw, pwede niyang mabawi yung portion na sa kanya dapat.

Kahit po nagbigay ng acknowledgement yung mga tagapagmana na donated ung land na iyon?

And anu ano po kaya yung mga remedies na maaari naming gawin?

Hindi sapat yung acknowledgment yung mga tagapagmana. If payag sila until this day, then they can execute a Deed of Donation in favour of the public school donating the portion that corresponds to them. Pero dun sa heir na ayaw magdonate, pwede niya mabawi yung portion na sa kanya dapat.

And please take note that the donee (the public school) has to accept the donation in writing. Otherwise, walang bisa yung donation.
