breach of contract of lease for the lessor

good day po,

magtatanong lang po ako about sa case na possible ko ma encounter this coming days, sana po amagbiyan nyo ako ng advise at maraming salamat po sa mag sasagot !

i have an existing contract of lease pa na sa june 2016 pa matatapos para sa isang commercial space. Ang gusto ng lessor ko e paupahan ang buong building kasama ang space na naka lease sa akin. 20k ang upa ko monthly, ang sabi ng lessor ko e babayadan nlng daw nya kung magkano ang upa ko for 18 months remaining (20k x 18mnts)
3 years na kami na umuupa dito, lahat ng income at expenses e nakarecord 45k-60k ang net income ko dito monthly. gusto ko sana ipaglaban ang rights ko kung meron man...

sa palagay nyo e pwede ba ako humingi ng higit pa sa ibinibigay nila sa akin? kabuhayan kasi namin ang nka taya dito

REPLY:

YOUR CONTRACT WITH THE LESSOR IS A PRE-EXISTING CONTRACT GOOD UNTIL 2016. UNLESS, THERE ARE SERIOUS AND VALID GROUNDS COMMITTED BY EITHER OF YOU, BASED ON THE CONTRACT OF LEASE, THE CONTRACT OUGHT TO BE RESPECTED. NOW, CHECK ON THE CONTRACT, IF THERE IS A PRE-TERMINATION CLAUSE (SIMILAR TO THAT YOU ARE ENCOUNTERING NOW) - THAT, THE LESSOR COULD UNILATERALLY TERMINATE THE CONTRACT BY PAYING THE LESSEEE THE UNEXPIRED TERM OF THE LEASE OR THE RENT INVOLVED. IF NONE, THE CONTRACT WILL SELF DESTRUCT 2016.

AS A LESSEE THE LAW ENJOINS THE LESSOR TO KEEP IN YOU IN PEACEFUL POSSESSION OF THE PROPERTY SUBJECT OF THE RENT AND TO ENJOY THE SAME UNTIL THE EXPIRATION OF THE CONTRACT.

IF THE LESSOR VIOLATED THE COVENANT WITH YOU, THEN YOU HAVE ALL THE RIGHT TO SUE FOR BREACH OF CONTRACT WITH DAMAGES.

thanks atty for the reply,

i already talked to my lessor and warned her that if she will re-rent the property that is leased to me that i will sue her! and i told her that i am open for settlement if she will pay not only for the total monthly rent for the remaining contract but for the average total net of my earning for the past 3 years.And maybe she have realized that she will be in big trouble and will loose more money if she continued her plan...Again thanks a lot to all of you!
