Hi,

Just want to ask if it's valid to abort the signed contract?
The contract says that if i backout I need to pay them 1 month of my salary.

I'm about to start 2 months from now but i decided not to continue.
Can i just abort it and nothing will happen?

Thank you...

When did you sign the contract?

You are liable for complying with the terms and conditions of the contract.

The Civil Code says:

Art. 1315. Contracts are perfected by mere consent, and from that moment the parties are bound not only to the fulfillment of what has been expressly stipulated but also to all the consequences which, according to their nature, may be in keeping with good faith, usage and law.

in addition: the contract stipulates payment of 1 month salary...so by the terms of the contract u pay, otherwise, breach of contract...

but the qouted provision above by council is correct.

Hello,

I'm not a lawyer or anything; I just wanted to say I also signed a contract which I very much regret having signed. What I did was I have tendered my resignation and gave 30 days' notice (which the contract I signed (and the HR) says I should do). I'm entering what should be my 4th and last month with this job.

Unfortunately (as I've posted elsewhere in this forum) my boss won't accept my resignation (which is why I find myself asking for advice in my post elsewhere). Anyway just wanted to say I know how you feel and I hope you won't have any problems like mine in backing out of your contract.

Good luck!
