I am no longer a Filipino citizen and I live outside the Philippines.  I want to file an Adultery case against the woman my husband is having an affair with.  Am I eligible to file and is it necessary to file the case in the hometown where the woman lives or, for safety reasons, can I file in one of the RTCs within the province of Nueva Ecija?  May I please know what the procedures and requirements are?

Note:  My husband is also from the Philippines and not a Filipino citizen anymore.  According to reliable sources, the affair started in 2011.  The woman is still married and currently living with her husband and 3 or 4 kids.  My husband bought a lot and have a house built for the woman.  He had the woman's new house fully furnished, gave her 2 tricycles, 1 single motorcycle, 2 live cows and had been regularly sending her financial support.  I was able to secure copies of bank wire transfer to the woman,text messages on his cell phone, pictures and video of the woman.  Are the stuff that I was able to gather valid proof of their affair  What are the chances that the rresult of the case will be in my favor?

other than adultery, you can file another case against the mistress for Violation against woman and children, a special law.

Hi,

Adultery is not the proper case to be filed. If you want to sue your husband and his mistress, the proper case that should be filed is Concubinage and only if you can prove that your husband is living with his mistress. Otherwise, you cannot sue him on this. Furthermore, since your husband is no longer a citizen of the Philippines, you can only sue him for Concubinage if you can show that at the time he started living with his mistress, he was still a Filipino citizen. Otherwise, you cannot sue him.

If you and your husband are dual citizen, you can sue him, if not! You are both out of Philippines jurisdictions! Any case you file against them will not prosper!

I'm sure you have enough money to waste because you are earning dollars now so go ahead and waste your money with your case that is not likely to prosper! It will take years and your money will be well spent so GOOD LUCK on winning the case if you can! m3
