Hi! good day!I applied for student visa to U.K last january 2010 barely 2 months after the marketing representative had an orientation with me regarding their services offered. I paid the amount of 50, 000 pesos through their bank account because of the following reasons: First, because the Market Rep. told me that if i start the application, i can probably join the next intake. Second, no Ielts requirement. Third, the tuition fee was affordble during that time. However, the Processing agency was not able to lodge my application to the school where im supposed to be admitted because of the recent changes in the UK border agency which affected my application. That includes IELTS requirement and the tuition fees that are getting high. So i decided to withdraw the money but when i informed the agency, they said that i cannot get the refund because according to them we had a verbal agreement made by the marketing representative during the one on one orientation. Even if I did not signed the MOA, it doesnt mean i can still get the money because they had rendered service. Added to this, they were claiming that the Marketing Representative informed me the NO REFUND POLICY during the orientation which in fact is not true. Moreover, when i talked to the Marketing Representative who gave the orientation, he said he wont comment at all because he's no longer working at the agency.

In my own point of view,the agency must be presumptuous to conclude that i already agreed to apply after the orientation and there was no meeting of minds because the orientation only revolved around the services they offer, and the terms and conditions laid on the MOA were in no event discussed to me especially the no refund policy. In addition, the agency cannot continue the process or even just to lodge my files at the school because of the fact that i dont have the IELTS qualification yet. So how can they claim having rendered service?

My question is that can I still get the refund now that the MARKETING Representative wont give his comment with regards to this? PLease advice . Thanks
