More than 1 year na po ako sa company and Im trying to avail the solo parent leave. I already showed them my Solo parent ID however the HR head told me that they can't provide me that leave since my tax status is not updated. My current tax status is married and its my ex husband who's claiming the deduction for our two kids. As per our company's HR, my tax status should be single. I just need to verify if that is a valid reason because when I got the ID, i was not informed by the representative from DSWD that i need my tax status updated before I could avail for the benefits

that is not a valid reason. it is oversimplification to require you to be single (which is not possible if you are married) in order to avail of the solo parent act. a solo parent is defined as:
(a) "Solo parent" - any individual who falls under any of the following categories:

(1) A woman who gives birth as a result of rape and other crimes against chastity even without a final conviction of the offender: Provided, That the mother keeps and raises the child;

(2) Parent left solo or alone with the responsibility of parenthood due to death of spouse;

(3) Parent left solo or alone with the responsibility of parenthood while the spouse is detained or is serving sentence for a criminal conviction for at least one (1) year;

(4) Parent left solo or alone with the responsibility of parenthood due to physical and/or mental incapacity of spouse as certified by a public medical practitioner;

(5) Parent left solo or alone with the responsibility of parenthood due to legal separation or de facto separation from spouse for at least one (1) year, as long as he/she is entrusted with the custody of the children;

(6) Parent left solo or alone with the responsibility of parenthood due to declaration of nullity or annulment of marriage as decreed by a court or by a church as long as he/she is entrusted with the custody of the children;

(7) Parent left solo or alone with the responsibility of parenthood due to abandonment of spouse for at least one (1) year;

(Cool Unmarried mother/father who has preferred to keep and rear her/his child/children instead of having others care for them or give them up to a welfare institution;

(9) Any other person who solely provides parental care and support to a child or children;

(10) Any family member who assumes the responsibility of head of family as a result of the death, abandonment, disappearance or prolonged absence of the parents or solo parent.

I already asked our HR representative to show a hardcopy stating that my tax status should be single or head of the family before I could avail of such benefit. They refuse to show me any company or any provision in the solo parent act that would state that policy, but they're still refusing me to have the solo parent leave. What are the possible steps that I need to do regarding this?

put your request in writing. make sure you have proof that they received a copy. if they still refuse, your remedy is to file a complaint at DOLE.

my employer already granted me the parental leave. I followed your advise, attorney, to put my request in writing. I also provided our HR department with the copy of the entire Solo Parent Act, and viola! My leave was granted within 12hours

prepare the ff documents po:
1. birth cert of the child
2. cenomar (cert of no marriage)
3. brgy certification stating u are a single parent
4. 1x1 id pic(some municipalities require 2x2 id pic)

once you have completed all the necessary documents, proceed to the DSWD office of your municipality. They will interview you and once everything's okay, they'll give you the solo parent id. Smile

hi atty! i just wanna ask if it's true that i cannot file my parental leave for personal reasons? i already have an id.. i tried to file my parental leave but my boss said that i can only use it if there's an event in school that i need to attend or if i need to bring my daughter to the doctor. and if that so, i need to submit supporting document from school to prove na may event talaga, or medcert from a doctor kung ipapacheckup ko talaga siya. what if we will pasyal lang to spend quality time, hindi ko na sha pwedeng gamitin? i hope you can help me asap because my daughter's bday is near na, only 2 people are allowed to file a leave for a day so baka maunahan ako sa slot.. thank u so much atty..

the law doenst require that although i would advise you to reserve it for emergencies. you can file a complaint at dole
