Company Driver driving company van ran into a speeding motorcycle on his way back to the company headquarters from a company-approved trip. The motorcycle driver was found to be beating the red light and only carries a student license and does not have someone who has a valid driver's license. Is the company also liable for the damages/hospitalization of the motorcycle driver or is it the sole responsibility of the driver? The company driver was on duty from 1PM until the accident happened between 1:30AM-2:00AM.

The company is jointly responsible since it allowed the driver to perform his duties even when he is not supposed to do so.

Hi!

We are actually trying to settle matters out of court. The only issue is the company is forcing/influencing the driver, through threats that the Penal Code says that he is solely responsible for the victim and the damages to the company property,to sign a paper that says he will assist financially. They are only saying that the company will give assistance but won't sign for it. What are our options here?
