Hi all,

Just like to seek an advice on this issue.

We were working sa isang BPO company then nag close ung account nung March 30. We were put on floating status for 45 days until they can find an account that we can transfer to. unfortunately after the floating period, walang tumanggap samin so we started to file a clearance and we were able to complete it ng May 17. According to the company, 2 months to wait for the separation pay and the final clearance.

So we are expecting that sometime this week ok na yung final pay. But dun sa mga nanunang mag inquire sa Finance division, ang sabi ay na delay daw ng HR yung endorsement sa kanila. July 9 lang daw nila nareceived ang clearance forms, so we would wait pa until September 9. Then when we verified sa HR, the reason for the delay daw is that they extended the floating status.

We did not received any notice or even tawag from them about extension. Even nung nag clearance kami hindi naman sila nagsabi na flaoting pa rin kami.

Tama po ba yung ginawa nila? Ano po ba ang magandang action so we they can expedite yung claims namin?

Floating status is generally good for up to 6 months.

What do you mean "started to file a clearance" ?

Did you file your resignation after the 45 days?

What do you mean "started to file a clearance" ? --- nag pa clearance na po ako and na file na sa HR nung May 17. Wala naman silang inadvice about extension and inaccept naman nila ung clearance form. Hindi po ba dapat na advise nila kami na extend nila yung floating status at sana hindi muna nila kami pinag clearance?

Mahirap magpa-clearance kung walang resignation letter.

ang instruction kasi samin was that after ng 45 days na floating status and walang account na nagaccept samin, we are considered redundiated na and we can proceed with the clearance. So nag clearance na kami para maformalize na yung separation namin.

Pero ang nangyari, inextend ung floating status namin and we were not aware of it. we were expecting a pay this July pero dahil sa inusog nila ung separation date namin, naurong tuloy ung date ng pagbayad nila samin.

So, is it legal for the company to not notify us about their intention to extend our floating status, when the initial understanding was 45 days lang?

by law, you can be put on floating status for not more than 6 months...
