In our barangay,some residents formed a homeowner's association more than ten years ago although our place is not a subdivision.Membership is voluntary.I purchased a land and plan to build a home in it.The previous owner is not a member and hence he did not pay any annual dues.They said if the arrears of the previous owner is not paid,the association will not give clearance to the construction permit, and delivery of construction materials will be blocked by the security guards.Does the Homeowner's association have the powers to do so?

if there is no annotation written on the title, then you cannot be forced to become a member of the association. if they prevent you from building, then the recourse is to file a complaint at the barangay
