as long as the husband contracted a second marriage while the first is still subsisting, then it is bigamy.

what case can the first wife charge against the second wife? and what if the first marriage is annulled, can the first wife still charge the husband of bigamy

even if the first marriage is annulled, bigamy will still prosper. the second wife can be charged with marriage contracted against provisions of laws.

"marriage contracted against provisions of laws" is a separate crime defined by the revised penal code. it is the act of knowingly entering into a marriage contract in spite of knowledge of a legal impediment.

vanessa, it depends on what evidence both sides will present, and it is the prosecution which has the burden to prove that the second wife knew of the first marriage.

sir, still in bigamy.. can the second wife (married thru shariah court & knows that the 1st marriage still subsists) file a case against the first wife who got married ahead of them? ... the husband (a govt employee) is now dead and both wives are fighting over the monetary benefits...

i'm sorry, i don't know enough about shariah law to comment, but i would think the other wives would have some form of property rights also.

sir, i met a girl habang nasa ibang bansa ako (ksa) and she got pregnant. i arrange a marriage certificate for us para maayos ang papel ng bata and be legally documented here(ksa) para hindi kami makulong pareho.
my wife back in philippines know this things and do nothing about it at that time. after we got seperate (not legally) and i stop sending money because we got argue about the money for our child.
she wants to file a bigamy case to me. which is she claim that i married again.
can the arrange marriage certificate be grounds to bigamy even we bought know there is no wedding at all.

If the marriage certificate is falsified and the affair is outside Philippinne jurisdictions, she can't sue you for bigamy as it will not be recorded to NSO. But the child with your partner in KSA is enough evidence for concubinage, if she can get hold of the child's birth certificate.
You cannot abandon your chidren with your wife as she can get you for Abandonment and RA9262. So if I were you, send money for your children with her for child support to avoid any further problems in the future.

what do u mean by that atty? na kahit annuled sang lalaki sa unang asawa at ngpakasal sa 2nd woman considered as bigamy padin po?
