Arresto Menor

I have worked for a company for over two years. Around two months prior I have applied for a 2 day leave granting me 4 days no workday including the 2 day leave plus the weekend in between. It was approved and I have booked tickets for a vacation. Everything was in place along with my paid accomodations for the said leave. About 1 week prior to the leave the old manager resigned and a new one came in. The said leave was then revoked on the grounds that, according to the manager, "he was new and was afraid of any events of which he might be unprepared to handle and needed my help". I have already paid for my vacation and they were non-refundable and non-transferrable. So I took my leave with a warning from the manager that it was insubordination. I took this however to mind because no talk of recompensation for the paid affair was established. When I got back to work I was terminated. Do I have any option legally regarding this? Thanks for your help.

You were terminated on what grounds? What documentation was served?

Was due process observed?

Thanks for the reply. Insubordination was the grounds for termination. Isubordination case was served. Im sorry to say I do not know however what proper process should have been done so I cant say if due process was observed.

Were you given a notice to explain?
Were you given 5 days to explain?
Was a hearing conducted?
Was a decision served to you?

If any of these is missing, then there was failure to observe due process, and you can file a complaint for illegal dismissal.

I was given notice to explain which I did, however no hearing was done. I have decided however to leave the matter as it is since I have lost interest and faith in that company. I thank you for this knowledge however which will be usefull to me in the future.

Sorry but I have just found greener pastures as it is. And preoccupied as I am I do not wish to waste time on some possibly fruitless venture when I have something else more tangible. I only asked for legal options because I was a bit curious whether it was a proper dismissal or not. Anyways I am sorry if you feel that I have wasted your time. It was a pleasure seeing someone respond to my inquiries.
