Hi,

I have a question,
My sister is married. They planning to buy a house and she wanted to name it under my name.

Does Her husband have a right to the house?

If they do the divorce does her husband have the right to own the house that they bought for me?


Looking for an answer pls. help.

If it is named to you then the husband does not have rights for it! Its regard as present/gift.

I got one more question.

What if the house that they going to buy while still married they name it under their kid?
The boy is still under age and my sister husband is not a real father of the kid.
Does her husband have right to the house?

I think the husband have right over that property. Kasal na sila so lahat ng property that will be buy are conjugal. And kung ipapangalan sa iba ang property (papalabasin na gift) just to hide it from the husband, that's unfair sa palagay ko may liabilities ang babae. Foreigner ang husband?

Naming it to other people is a smart strategy to steal from her husband! Even she is married to her husband if she buys properties and put it into siblings, children or parents name this does not give her husband rights to claim it back! The same way as what my mother did!
Here's a sample story for you;
I bought properties and I trusted my mother so it was put under her name and when I come home from abroad, the properties is already sold. I tried to do something about it, but the fact that it was under her name temporarily while I was working abroad, this gives her right to sell my property. My lawyer said it's a mistake to trust her to put the properties under her name.

The kid is only 10 y/o is she can name it to a child even the kid is under age?
If they divorce and the kid is still under age. Does the parent has right to sell the house?

NO! If it is under the kids name already, the kids will have the full access when turned 18.
