Question po,


Anu po ba ng mas mag kapangyarihan mag takda ng basta ?


For Example.

Sa lugar po namin, Meron existing Municipal ordinance na ang kalye namin ay NO Parking zone, nung may naupo Barangay Capt. implementa ng Brangay ordinance na pwede lagyan ng one side parking, pero mayroon bayad.




Ang tanung kanino sa dalawang ordinance na ito ang dapat sundin?

There are two interpretations for that, namely,

1. The municipal ordinance is the general rule and the barangay ordinance is the exemption, for it covers only one side of the road. OR

2. The 2 ordinances are conflicting, thus, the municipal ordinance will prevail being superior one, for it has the power to control and supervise barangay units.
