Positive drug test result grounds for termination.

Hello guys, I hope you can help me answer my current case. Let me give you the preview of the case against me. Last April 23, 2014, the company issued an NTE against me. The charges are:
1. smoking inside the company premises, suspension.
2. bringing illegal drugs in the office premises, dismissal.
3. reporting to work under the influence, dismissal.
The company has a zero tolerance policy against use.

Here are the facts:
1. Sabi sa report someone "seen" me smoking an illegal substance nung April 21 sa fire exit ng office. Pero ang nangyari talaga is that I use the fire exit staircase to go down floors. The department im currently in is located at the 18th Floor, pantry area to kaya maraming tao gumagamit ng restroom so iopted to go down and use the restroom sa 17th or 16th depends kung ano yung walang tao. I was walking and not loitering and then meron lang utility guy na nakakita sken bumaba. walang cctv sa fire exit kaya I cant prove my innocence pero ang illogical lang magsmoke sa fire exit since nagssmoke naman ako sa designated smoking area. I did not, do not, and would not smoke dun sa fire exit. Wala ngang proof yung nagsumbong yet ginawa tongg grounds ng company for me to have a drug test.

2. Hindi din ako nagdadala ng illegal drugs sa office. I do commute papunta sa office and I always enter the mall and if ever meron ako dala for sure maamoy yun ng mga aso. Plus yung mga lobby guards nmen always checks my bag before and after I leave the office floor. If nagdadala man ako dapat nakita nila. Pero wala silang nakita sken kahit isa dito kasi ndi nga ako nagdadala.

3. Mas lalo na ndi nman ako pumapasok ng under the influence. Sa 9 years ko po sa company palagi po ako kasama sa random drug test and lahat po yun negative. Hindi ko din po alam pano ako magbibigay ng hard evidence dito kundi yung record ko na malinis.

All in all wala silang hard evidence against me pero meron kasi nangyari.

Prior ako idrug test for false accusation nung April 23. Galing ako sa long weekend since Holy week nun. April 19-20 nasa Bolinao ako together with friends and someone tricked me to eat a tainted brownie. Hindi ko alam na meron halo yun since normal looking brownie lang sya. Nalaman ko na lang nung nahilo ako and sinabi sken na merong halo. 420 daw kasi. Pero ndi ko friend yunh nagbigay. friend ng friend. Nawala na yung effect ng April 20 ng hapon kaya monday going to work normal nako.

Problem is coincidental mga nangyari. i was accused na smoking. pinaDT ako and sinabi ko sa nagadminiter yung nangyari. Sabi sken nasa system ng ng tao ang marijuana for 1 week. Feeling ko na magnenegative ako kaya tinuloy ko pa din ang DT. to cut the story short positive ako kasi sa naingest ko na brownies.

As per our company policy, meron silang zero tolerance and to quote them, its either suspension or termination depends sa Art 282 ng Labor code.

Ang issue ko lang is pwede ba nila ako iterminate kahit ma unintentional yung pagingest ko? 9 years na kasi ako sa company and umaasa ako na suspension ang first choice nila. If ever termination, pwede ba or valid ba na magfile ako ng case sa NLRC? sayang po kasi yung mga makukuha ko since 9 years nako sa company.

Unfortunately yes, as long as due process is observed, and the confirmatory test is also completed.

Thank you for the reply. I just hope that suspension muna yung first choice nila since i've been working with the company for 9 years and no bad record. Ano po ba mga options ko for them to choose suspension? Should I tell them na I'm open for unlimited drug testing for two years just to prove na I am not drug dependent?

Companies usually will go for the highest sanction to set examples and to show that there is no favoritism.

From experience, I doubt your "offer" will be accepted.
