Nag file ako ng Estafa case sa city prosecutor.. pinadalhan ng subpoena ang respondent, pero hindi nag reply (walang counter affidavit or controverting evidence), then eventually lumabas ang Resolution, "dismissed for lack of merit". paano nangyari yun? ang ginawa namin, nag file kami ng Motion for Reconsideration (MR).. that was last month.
kailan ko ba malalaman ang result sa MR? kung denied or what.
sasagot pa ba ang respondent sa MR namin? ni wala nga counter affidavit.
sa pakiwari namin, may pagkakamali na ang prosecutor when dissmissing the complaint (Resolution), dahil nag serve na sya ng subpoena. meaning may probable cause na nakita against the respondent. tama po ba? nakasaad din eto sa MR.. "When this Honorable Office sent the subpoena to the respondent, it presupposes that there exists probable cause against the latter, otherwise, this case would have been dismissed outright pursuant to Section 1 (b) of R.A. 5180 (As amended by P.D. 911)."
totoo kaya ang haka-haka na baka nadukot ang complaint ko or nabayaran ang fiscal?
ano kaya posible ko pang gawin kung ma deny ang MR ko?
