Good evening attorney! ang ina ko po ay isang guro at nagkaroon siya ng pagkakautang sa credit card.narelease yong credit card na may cash limit na 65k noong April 2008 at buwan buwan niya itong binabayaran at dahil sa di inaasahang pangyayari lalo na sa health naubos ang laman ng credit limit at dahil sa kakapusan ng pera huli siyang nakapagbayad noong december 2008. mula noon hanggang ngayon di kami nakatanggap ng demand letter pero last week may tumawag sa bahay taga CIDG daw siya sa campo crami.mag complaint daw against sa nanay ko na criminal case dahil sa di pagbabayad ng utang.. parang di mapakali ang nanay ko attorney. pwede mo po ba siyang bigyan ng advise tungkol dito baka kung mabaliw siya.. please!!!
pwede ba yong ganyan na didiritso sila sa CIDG? at balik sa CIDG na hindi naman criminal ang nanay ko attorney.Kailangan daw ng nanay na magbayad ng paunang 10k para maiurong ang complaint at ma withdraw ang T.R.O sa CIDG. tama po bang sa text lang sila makipag -usap ni walang legal documents?

more devious tactics by collection agencies. is there an atty. also involved as related by the other people in this site?

mere failure to pay credit card debt is not a crime. they resort to these tactics because they want to intimidate you into paying.

what your mother should NOT DO is to change her work and residential address without telling the credit card company because under the access devices act, that will be considered a sign of fraud.

to stop these calls, change your telephone number. if they come to your house, take their pictures and video, and call the barangay to witness.

nevertheless, the debt still exists. i recommend that you offer to make a decent downpayment and the rest to be paid in installments. while a criminal case will not prosper, a civil case for collection against you will. good luck.

Thank you po for your response attorney!!! i am very happy that there is one lawyer here that is willing to help and serve without any doubt... Merong attorney na tumatawag sa nanay ko palagi at galit na galit siya pag tumawag. Siya daw ay si attorney AXXXX .Sabi pa niya sa nanay ko nakipag coordinate na daw ang citicard sa companiero nila sa CIDG.Pag magbabayad daw si nanay i withdraw daw niya ang T.R.O sa CIDG..

Attorney paano po lumalaki na po yong amount na sinasabi nila eh ang naging 196k na na kung tutuusin daw eh 65k lang ang credit limit ng card at nakabayad na daw ng more than 20k si nanay..ang tanong ko po ay:
1. Pwede pa bang yong remaining balance nalang sa 65k-20k ang mababayaran ni nanay? kung pwede man po paano niya gawin ang agreement para maging legal? anu ano ang mga dapat gawin ng nanay ko..Siya lang talaga ang nagtatrabaho sa pamilya namin dahil sa nagkakasakit ang tatay ko at nawalan siya ng trabaho parang di kaya ni nanay na mabayaran ang ganong kalaking amount attorney..

Please help us...guro lang po ang nanay ko maliit lang ang sahod..

it's easy to impersonate an attorney, but assuming he's the real deal, i would not condone this kind of tactic.

i recommend that you go directly to the credit card company and make an offer. good luck.
