Land Transfer with old Deed of Sale

Hello! Just want to ask kung anong Batas ang nag sasabi na may expiration ang DEED OF SALE? Kasi po matagal na po kc naka pending yon, kc yung mother title nasa Landbank until now. Tapos the other day lang ang sabi sa mama ko nung pinuntahan nyang office palagayan daw ng signature ulit sa likod(nong Deed of Sale) kasi matagal n daw po.. ang problem is patay na po ung naka pirma. Please let me know kung ano po ang tamang process flow, at kung saan government office dapat pumunta. Please advise. Salamat po.

is the deed of sale notarized? is what you have the original copy?

now that you say there is a mother title, do you mean that only a portion of the property is covered by the deed? are you occupying the property? there is no individual title covered by that on the deed?

written contracts are normally enforceable for ten years, but they do not lose validity over mere passage of time.

Actually as per my Mother it's not yet notarized.
So now nya pa lang daw po ipapa notarize doon sa atty na gumawa noong Deed of Sale na yon.

Sa Register of Deeds po pumunta Monther ko.
Basta sabi po doon hiramin daw ung Mother title Landbank(main office).

So mean, ok lang po ba na now pa lang ipapa notarize yong Deed od Sale?

she can only have it notarized as to her own signature, not the signature of the decedent.

she cannot partition the property without the mother title. the bank will have to agree to release it to you.

According to Landbank, we need to verify that the property we bought is not belongs to the settlement document of the late vendor.
So, aside from his heirs/children where can we find a copy of settlement document?

it's either you have a copy of the document so you can trace it, or you'll have no choice but to ask the children.

gudpm po ask ko lang kung ano po ang sinasabi sa batas ng deed of absolute donation? ano po ba ang sakop nito..maaari po ba sila pumigil o manggipit..kasi po kmi po ay nabigyan ng perpetual right of way ng aming mga kapitbahay. isa po sa aming kapitbahay ay nakaalitan namin dahil sa inggit at isang araw na lang ay pinaderan ang aming dinaraanang gate wala na din po kami madaanan papasok at palabas.

the legal remedy is to file a case in court for mandatory removal of the wall and recognition of the right of way.

The situation is nakabili po yung lola ko ng land property last 2008. Sa isang buong land property dalawa ko ang ngmamay-ari which yung isang may-ari ang nagbenta at pinagbilhan ng lola ko ng half ng property. Beforehand ang tax po ng lupa is paid as buo. Later pinatituluhan po ng isang may-ari ang other half ng lupa without our knowledge. Ngaun nalaman namin na matagal na hindi nabayaran ng tax ang half ng property which is yung sa amin. Tanong ko lang po kung ano po yung mangyayari dahil po hindi nabayaran ang tax lupa at ano po pwede naming gawing para maupdate namin payment sa tax at mgkano kaya babayaran. let say 10years po di nabayaran ang tax...maraming salamat po...

I am no expert but want to answer your queation about tax ng lupa na dipa nababayaran. If its amilyar. Pwede ka punta sa cityhall or municipio mo at ipa compute ang babayaran. Sa accessor's office ata yan. Ask mo nlng kung saan bayaran ng amilyar. Baka meron pang amnesty ngayon or discount. Dito samin sa Las Pinas 20% off. Im not sure if applies to all cities.

sir/mam Kulasified, maraming salamat po..gusto ko na rin itanong kung wala kming hawak na titulo or mother title ng lupa...pwede ba deed of sale lng yung daldaldin nmin sa pgbayad ng tax?

Question:

My father bought a parcel of land way back in 1995. After his death in 2011 we found out that he was not able to transfer the title to his name. What we have is the deed of sale and the original title which is still under the name of the seller. What steps should we take for us to have the title transferred to one of my siblings?
