Hi Sirs,

I have signed a contract that I'll be starting to work in this company, it was stated there that I have to pay 20k if I resign before my anniversary and 10k after. This will be freed up when I reach my 2nd year.

The reason of the bond  is the client will train me, I guess it's just a knowledge transfer not a formal training.

My question is, if I decide to accept another Job Offer from another company, will I still pay the bond even if I haven't started to work with them.

Please advise.

Knowledge transfer or whatever you call it - it's still training.

Yes you may still be liable.

Civil Code:

Art. 1315. Contracts are perfected by mere consent, and from that moment the parties are bound not only to the fulfillment of what has been expressly stipulated but also to all the consequences which, according to their nature, may be in keeping with good faith, usage and law.

Hi Sir,

I have signed a contract this December 21, 2013 it stated to my contract that for 3years i will be their employee and if i ever i resign i will pay the amount of 500,000. I just want to ask if i resign will the company sue me to the court or will i go to jail? Does we have law like this or rules?

Hi Sir thanks for the reply, pero pede pa rin ba akong liable kapag nag sign lang ako ng contract pero di pa ako nagsimulang magtrabaho dun kasi I'm considering another company, salamat po:)

As I quoted the civil code earlier - you are liable to comply with the contract once you sign it.

Art. 1315. Contracts are perfected by mere consent, and from that moment the parties are bound not only to the fulfillment of what has been expressly stipulated but also to all the consequences which, according to their nature, may be in keeping with good faith, usage and law.

Sa simula ng pag payag mo sa kontrata (pag-pirma) pareho kayong may pananagutan na tapusin ang kung anumang nakasaad, kasama din ang kung anuman ang kalalabasan.
