Owner aq ng bagong panganak na dog na nakakagat ng 15 yrs old girl,, pinsan xa ng pinsan q, she is from manila nagbakaxon lng for fiesta....

Jan.2 nakagat xa ng dog q sa part ng binti,, sa loob ng compound namen e nadadaanan un ng mga tao bago makapunta sa computer shop ng pinsan q.
That night inilabas q ng cage ang dog q as usual para pakainin inilagay q xa sa balcony namen,, nung pumasok aq para mgahugas saglit ng hands may narinig aqng tili and kahol ng mga dog so i ran outside and called my dog,, nakita q lng ung dog q infront of the house pero walang tao and narinig q ung kapitbahay na tinawag din nila dog nila,, after 30min. Biglang nagsabe saaken na nakagat xa ng aso q pero pinaga na nila ung sugat,pinilit paduguin ng paduguin,kinuskos ng bawang ang detergent bar soap ng paulit ulit,,, nakita q nlng ung sugat parang half P5.00coin kalake and swolen ung surrounding and its changing color na,, tinanong q pa xa kung sure xa na dog q nakita nya na kumagat sakanya sabi nya oo daw so dinala q agad xa sa nearest hospital saamen and binigyan xa ng anti tetanus doon then sinabihan kame na kinabukasan magpunta sa ibang hopital para sa anti rabies vaccine ,,

Jan 3 morning pinaturukan namin xa ng anti rabies vaccine sa another hospital,, binigyan din kami ng reseta na gamot na iinumin and i ienject sa wound kc nainfection dahil sa bawang,,

ang saakin lang kahit b ganon ang ginawa nila sa wound nung pasyente aq padin sasagot non?

E sagot q n po lahat gamot, pamasahe and foods nila..... tapos ung father kumunsulta sa private hospital without telling us nagulat nlng kame may bills and medicine computation na ibinibigay saamen e alam nyo nmn sa private,, after that iniwan nya na saamen and sa tita ung anak nya kami na daw bahala uuwi n daw xa ng manila dahil my negosyo pa daw xang aasikasuhin,,,

Ano poh b dapat qng gawen? Iniiskandalo p kame ng mga relative almost everyday ,, ginagampanan nmn namen lahat ng dapat gawen and wala na cla ginastos ni centimo,,,,

Good evening!

I would like to ask for advice.
My grandfather in law was bitten by our neighbor's dog just this afternoon. The owners were not at home and my grandfather was walking by their house and the dog came up to him and started to bark at him; My step grandfather always brings with him a stick since he has problems walking. As a response to the barking, he started to raise the stick. The dog then started biting him on his arm, hands and his side.

Good thing my grandfather has a stick and started hitting the dog. He ran to our house and asked for help. My sister in law helped our grandfather and brought him to the hospital.

Later that afternoon, my step father went to the owners house and informed them about what happened and asked to have the dog caged for awhile since he could attack children. Our grandfather is old and is strong and good thing he got a stick with him (the neighborhood is near an elementary and highschool).

My step father was appalled by the reaction he got from the owners. They said it's their territory,our grandfather was trespassing. They said the way beside their house is not a right of way, so no one should pass by there.

To give you guys an overview of the location or the place as to where it all happened. It is true that it is their territory, but the thing is, a lot of people walk by their house. There are a lot of houses/homes at the back of their house and the people there always use the side of their house to pass by. A few years back, they attempted to close it and put gates but a lot of people protested and it was even brought up to the Barangay. But they resolved it, they were asked to not close it down as it is the closest way to get to the highway. They agreed to not close it. All of us pass through their house every time.


AND, kamag-anak pa sila ng in laws ko. So I was kind of stricken by their reaction. For goodness sake, matanda na ang nakagat. I believe uncle nila and step grandfather ko.

Wala pang tumulong, a simple sorry and an assurance to put their dogs on a leash /cage for awhile is good enough. My step father did not go there to ask for money or anything.


What I would like to know is if they can get away with what happened, as what they said our grandfather was trespassing. What can we do? I read online that once a dog break skin, the police/government can give the dog another chance, if they bite another person, they can issue to terminate the dog. I got it from US law. I am not sure if we have that here in the Philippines. Or what laws we have here in the Philippines for dogs that has broken skin countless of times.

I don't know the history of the dog though, if he has bitten others.

I am not PRO to killing dogs, I love dogs. My in laws love dogs. We have dogs of our own. But I would just like to know what we can do. Any legal issues/steps we can raise?

Good pm po..ask ko lng po ung case ng aso namin.nung nakaraang gabi po kc nkakagatgat ng anak ng kapitbahay ang aso namin. Pumunta po kasi s bhay ung binatang anak ng kapitbhay namin ksama ang kapatid nya at dun po s loob ng bhay nag away at nagsisigaw. Ang aso po namin nkatali tapos po ung binata nagsisigaw dun s tapat ng aso kya po nkagat xa. Lm ko po trespasing ang ginawa nya, ginwa po ng nanay ko pumunta s bhay ng nakagat at nag offer ng 700 pro that night sbi nung tga alaga n lola n wg n dw kc d nman kasalanan ng aso nmin un..kingabihan nkatangap kmi ng email mula s mgulang ng mga bata at pinasasagot ang gastos ng vacine. Sinbi ng nanay ko n d nmin kasalanan magbi2gay kmi ung kya lng namin..nagbgay ng 500 ang nanay ko pro pinalalaki n nila ang issue ngaun.. at ang sbi p nila wla dw kmi laban kc aso nmin ang nkakakagat miski p nkatali at nsa bakuran namin..miski dw magtanung kmi s abogado,nagbgay p ng example n kpag dw pinasok ng magnanakaw ang bhay at nkagat ng aso sgutin dw namin un..anu po b ang pwd nyong maipayo..thank u

helo po atty... may aso po kc sa apt namin na inaalagaan ng roommate ko... ngayon nung lunes May 19, 2014 ai hinatid ng may-ari yung aso sa apt para paalagaan sa roommate ko kasi pupunta siya ng palawan... noong wedz morning aggressive masyado ang aso at biglang kinagat ako,,,,, since nakagat ako sino po ang mai liability sa lahat ng gastos.. and if ever i charge po muna un sa healthcare card ko, pwede ba akong humingi pa rin ng refund sa lahat ng gastos since d pa naman nla in-aako ung expenses.? thank you po!

Sa aking opinyon, sa pagkaka alam ko po kapag po ang inyong aso nakatali man or hindi, basta nakapinsala sya sa loob ng bakuran ng may-ari, ang may-ari ang may responsibilidad sa pagpapagamot sa kanyang nabiktima, maliban na lng kung may trespassing na naganap (kadalasan nito mga magnanakaw).

hello po .. i need legal advice po about my dog biting the assistant of my vet .This is the first time na may kinagat siya. two days ago po kasi, pinagroom namen ung dog ko na mismong vet niya. Medyo matapang daw kaya i was advised na turukan ng gamot. Nag agree naman po ako kaso sabe ng doctor na nagturok sa kanya pampahilo lang kasi kumain daw ung dog. They waited for several minutes para mahilo ung dog . Bumalik na lang po ako after an hour tapos pagbalik ko sabi kinagat daw nung dog ko ung assistant ng vet. Sa may bandang ring finger po ung kagat and I think, slice ung kagat sa kanya. Nakita ko po tinalihan nila ng straw ung nguso niya at hilo na ung aso. Kumpleto naman sa vaccines at lahat lahat pero sabi nung vet i need to shoulder the expences ng gamot nung nakagat . Ive read several blogs about this kind of scenario and I realized na it's the responsibility of the vet to control the dog since they were trained for it. Ang kaso po, this rule only applies abroad. May certain law po ba dito sa phil para dito . please help . .. Sad

Good day!

I really need an advice on this one. May aso po kasi dito sa amin na nakakagat ng 4 na bata at isang may edad na. Ang problema, ayaw angkinin ng may-ari na sa kanya yung aso. Sabi nya, di sa kanila yun pero pinapakain nya lang ng mga tira nila kasi nga sayang daw. Ngayon po, kanya-kanya na lang ng gastos yung mga nakagat kasi nga ayaw sagutin nung pinaniniwalaan namin na may-ari nito. Sa pagkakaalam ko po, kahit na di sa kanya yung aso pero kung pinapakain nya ito at dun din sa kanila natutulog, diba dapat responsibilidad nya parin na e-shoulder o kahit sagutin nya lang partly yung expenses ng pagpapagamot? Ano po ba ang tama naming gawin tungkol dito? Itinatanggi nya kasi talaga na sa kanya yung aso.

Magandang araw po sa lahat!

Hihingi po ako ng advice dahil nakakagat ang aso ko.

Hindi po nakatali ang aso ko (shih tzu-chihuahua breed) dahil mabait at malambing naman ito. Minsan, nakakalabas ito ng pinto pag naiiwang nakabukas pero hindi ito lumalabas ng gate.
Nagpapadedeliver kami ng tubig pang -inom. Sa tuwing darating si Manong (delivery man) ay nagtatatahol at galit na galit ang aso ko. Alam na alam naming lahat pag nasa gate na si Manong kasi nga galit yung aso kaya kailangan kalungin yung aso o itago sa kwarto para hindi makita si Manong.
Nakagat daw si Manong ng aso at dumugo ang sugat. Dadalhin ng tita ko si Manong sa clinic para pasaksakan.

Ang mga tanong ko po:
1. May pananagutan po ba kami sa lahat ng gastusin at pagpapagamot kay Manong kung nakagat siya ng aso sa loob ng gate namin pero alam naman niya na may aso kami na galit sa kanya at pumasok pa rin siya?
2. May pagkakaiba po ba kung:
-pinapasok siya ng aming gate at nakagat ng aso?
-hindi pa siya pinapapasok pero pumasok na siya sa gate namin at nakagat ng aso?

Hi!

I need help po regarding dog bite issue. Nakakagat po yung aso namin ng 5 na tao. Nabigyan na po silang lahat ng pera for medical expenses. Dalawa sa mga nakagat ay isang bata at may edad na lalaki sa malayong subdivision. Nakatakas ito sa bahay namin, lumundag sa gate. Nasagasaan daw po ito ng tricycle at nagwala kaya nakagat yung bata at lalaki. Pinatay po nila yung aso namin so hindi maprove kung may rabies nga. Napavaccine na po ito nila lolo, sa kanya kasi yung aso at nawala nila yung record ng vaccination. On the day po na nakagat sila, eh nabigyan po sila ng pera para sa kanilang tetanus at anti-rabies shot, consultation fee kahit na po libre yung mga un sa malapit na ospital dito sa amin.

Dalawang beses pa nga sila nagpunta sa bahay at humingi ng pera. Nagulat na lang po kami ng nagpunta sila kahapon at nanghingi na naman ng pera. Yung tatay nung bata at yung lalaki ang nagpunta sa bahay namin, galit na galit yung tatay, nageskandalo na siya. Nagulat kami kung bakit ganoon at nanghihingi pa eh nabigyan na nga ng pera para sa gastusin sa paggamot. Yung isang lalaki naman, sinasabi nia na hindi daw sia nakapasok sa trabaho 2 days na dahil daw sa kagat ng aso namin. Nagcomplain po sila sa barangay at may summons kami bukas. Ano po bang depensa namin sa kanila? Halata naman pong namemera na sila. Sabi pa nung friend kong lawyer din, abuse of right daw. Yung nakagat na lalaki pwede pa siguro namin bigyan if mapatunayan nga nia na kaya hndi sia nkapagtrabaho dahil sa sugat nia. Tama po ba?

Whether its trespassing or something else kasi sabi din sa batas na kailangan vaccinated ung aso. So my question po eh, we gave them the medical assistance needed and now, they're asking as to give them money because they lost their job. Should we give them that po ba? kasi sa law sabi incidental expenses relative to the victim's injuries pero di naman po siya expenses. SO SHOULD WE REIMBURSE THEM PO?

Hello. Question po. I have a friend who is a missionary and they are doing a missionary work which they have to go house to house. Unfortunately yung isang bahay na kinakatok nya eh may aso pala sa loob. Mat gate naman pero may butas pala na kasyang kasya ang aso and that instance nakagat sya nang hndi man lang tumahol ang aso kaya hndi nya alam na may aso pala. Ngayon nang kinokontak na ang mayari nung aso. Iniinsist nila na wala silang pananagutan sa nangyare dahil nasa loob ang aso nila hndi rin sila naniniwala na hndi tumahol ang aso dhil konting kaluskos lang daw eh tumatahol na iyon which is that time eh hndi nga tumahol kaya pinagpipilitan nilang wala silang pananagutan. At sila pa ang matapang na magsusumbong sa brgynat pulis ksma ng presidente ng subd dhil sa walang permit ang pagiikot nila. Pede po bang makahingi ng advice tungkol dto kung wala ba tlgang pananagutan ang mayari ng aso at kung may nilabag din bang batas ang friend ko? Thanks po sa sasagot. Godbless po.

hello po. may tanong lang po ako. ako po kasi yung pet owner. nakakagat po kasi yung aso ko ng kapitbahay namin. sa gilid po kasi ng bahay namin may kulungan po ng 2 aso, ngaun ung dalawang pinsan ko nilinis nila yung kulungan tapos po nung pinapasok na nila nakita po nung kapitbahay namin na may aso pero lumapit pa din po sya kasi khit malayo po matatanaw nya na un at matagal na po nila alam may aso dun sa property nmin.nakatali po yung aso namin hawak ng pinsan ko yung tali nung biglang dumaan ung babae at nakagat dun po nangyari sa tapat ng bahay ndi naman po lumagpas ng gutter. pananagutan po ba namin yung nakagat?

pero considering na kapit bahay po namin ako po mismo nagoffer na papabakunahan namin pero sa alam ko pong maayos at affordable na clinic nung araw po na magkikita kami sa clinic na napagusapan, kakain lang daw po sila pero nung binalikan namin sa kinainan nila wala na po sila at pinatayan ako ng telepono tpos nagmessage sila ulit na nagpabakuna sila sa iba at gusto nila magbgay kami ng mahigit 9k sknila. may resibo naman daw po sya ng bakuna. may laban po ba kami kung sakali na ndi namin ibigay ang 9k na hinihingi nila? kumpleto po sa vaccine ung aso ko at pinakita ko po sknila na updated un sa anti rabies

keep making an offer of what you think is reasonable, but if this actually reached the court, my thinking is that the court will grant the 9k if it can be proven that it was what they paid. of course you can counter check because it should be just around P1,500 per shot

yun nga daw po sbe attorney nung clinic na pinuntahan ko pati po sa mga kakilala ko ndi daw po aabutin ng 3k ang buong session nung may pinabakunahan din po sila. dhil kung ininform po nila ung doc na vaccinated yung aso no need na daw po mag ERIG (pinakita ko po sknila yung booklet na complete sa vaccine ung aso) . yun po yung inabot ng 6,500 na snsbe nla.
