Who is responsible in paying the Service Incentive Leave

Good day,

I am an Operations Manager and the people from the Manpower Agency whom we contracted are already over a year with us, as per labor law, contractual employees are eligible for a 5 day Service incentive leave. people have availed unfortunately they were not paid by the agency because according to them our company is responsible in paying or providing their SIL.

Now my question is who is responsible in paying the service incentive leave of the employees under the agency, is it the manpower Agency or our company who contracted their services.

in our MOA it does nor state that we are responsible inproviding people with the SIL, only worked hours and Overtime and the 13th month pay.

Please enlighten us on this.

they are entitled, and if the contractor does not pay them, they can claim from the principal and the principal has the right to be reimbursed by the contractor
