Hi,

Good day!

I've been with this BPO company for almost 7 years. I started as CSR then promoted as SR Quality Specialist.  I got suspended for Survey Manipulation, being part of the Quality Team I will not gain anything from such allegation. They were not able to provide solid evidence against me and they did not even scheduled me for an Administrative Hearing. I decided to go to NLRC to have conciliation, through SENA. But they did not respond and I was advised to file a complaint.

After a year of going to NLRC, twice a month, we've only seen the respondent's atty, thrice and they change their representative thrice as well.

Last November, we received the resolution that we won the case. As expected the respondent appealed the case. I would like to know if there's a way, proceedings, or policy to have this matter resolved ASAP, as based on the papers sent by the respondents and seen by the arbiter, there are no solid evidence to prolong the case.

I've been out of work for more than a year now, as I was expecting my papers, such as COE and the rest to apply for a new job. I'm really eager to have this matter resolved as I'm a mother of one. Also, this is my first job.

were you awarded monetary claims? usually they can only appeal after posting bond equivalent to the money claims... was this done?

Yes, I received the resolution together with the computation of the award. However, I did not receive the copy of their appeal, my lawyer did. I'm just really concerned about my case. I would like to know if there's any way that we can have this resolved ASAP. They do not have any evidence against me to support their allegation. Only alleged report, without investigation. Thank you for your response.

YOU WON.
Because of the technicality that your erring employer did not follow DUE PROCESS OF LAW.
Just demand for your monetary claims and COE.
Then move on.
Don't waste your time for non sense company like your previous.

you really ought to discuss this with your lawyer. inquire about accepting a lower cash settlement in exchange for dropping the case.
