Hi good day.

Hihingi po sana ako ng payo at paliwanag ninyo tungkol sa problema ko.

Na hire po ako ng isang kompanya as Accounting Manager para sa isang Project nila. Ang term po ng contract nila is 18 months.

Sa contract po ay walang specific duties and responsibilities pero nakasulat don:

10. The EMPLOYEE shall perform any and all duties corresponding to the position and any other duties as are customarily performed by the one holding such position with the EMPLOYER or with similar business enterprise or activities as the EMPLOYER.

After mahigit 5 months po ay nagkaroon kami ng di pagkakaunawaan ng Presidente ng kompanya na lumala. Yong Project Manager ay nag offer sa akin ng one (1) month salary kahit di na daw ako pumasok kapalit ng aking voluntary resignation. Sabi kasi nya para di na raw lumala ang sitwasyon at graceful exit na rin para sa akin.

Di ako pumayag at nag negotiate instead (through email) ng 3 months salary dahil mahigit pa one (1) year ang natitira kong contract.

Hindi nila sinagot ang email pero nag hire sila ng outsource Finance Controller na ang isa sa mga trabaho ay:

"Necessarily, I am also fully authorizing them to have access, to manage and otherwise handle our accounting, payroll and other finance related matters at Site."

Ang mga trabaho pong ito ay syang ginagawa ko sa kasalukuyan.

Ito po ba ay isang implied na paraan para tanggalan ko ng trabaho? Ito po ba ay nag violate sa terms and conditions ng aming contract? Ano po ba ang magagawa ko sa mga ganitong hakbang ng kompanya?

actually, you can resign immediately, just submit resignation letter effective immediately.. don't put any reason, just say you are resigning, don't put any THANK YOU etc...

for constructive dismissal, employee can stop employee employer relationship with valid grounds.. just make sure you have everything documented, emails, etc. then go straight to NLRC and file constructive dismissal.

Constructive Dismissal concept

Constructive dismissal is an employer’s act amounting to dismissal but made to appear as if it were not – a dismissal in disguise. In most cases of constructive dismissal, the employee is allowed to continue to work, but is simply reassigned, or demoted, or his pay diminished without a valid reason to do so.

Constructive dismissal does not always involve forthright dismissal or diminution in rank, compensation, benefit and privileges. There may be constructive dismissal if an act of clear discrimination, insensibility or disdain by an employer becomes so unbearable on the part or the employee that it could foreclose any choice by him except to forego his continued employment. (See Hyatt Taxi Services case, G.R. No. 143204, June 26, 2001.)
