annulment inquiry

Hi Atty,

I plan to file an annulment against my wife that has physically battered me in our whole course of marriage. We've been only married 1 year and i see that there is no point in continuing the marriage because this will just never end.

Is that possible?

physical abuse, by itself is not a ground for annulment. look up the grounds in the forum.

   ako po ay isang lalaki at kinasal po ako January 1994 sa civil wedding pero yung girlfriend ko pa po siya at bago pa man naganap ang kasal ay 7 buwan na siyang buntis sa ibang lalaki. Kung sakali po bang siya ay nagpakasal muli at sa simbahan ginawa ito, ito po ba ay legal at valid at wala po ba siyang pananagutan sa batas dahil sa mula ng bumalik siya sa kaniyang mga magulang ay di na kami muling nagkita pa. Sabi ng kanyang Tatay ay void daw ang kasal namin dahil wala kaming communication ng ilang taon at abandonment daw po ang nangyari at yung lalaki po ba ay walang liabilities sa batas natin. Wala po kasi akong idea sa mga bagay na ito at halos 20 years na rin po kasi kaming di nagkikita at nagkakausap. Sana po ay mabigyan niyo ako ng payo ukol dito. Maraming salamat po.

My kalive in po ako kasal po sya noong 2008. At that time 21 po sya at 19 naman po ung babae. Nagloko po ung wife nya dati at sumama sa ibang lalake, Ngayon po almost 3 years na silang magkahiwalay at may anak po sila. Nung kinasal po sila sa fiscal ng makati hindi daw po sila kumuha ng marriage license o umattend ng kahit anong seminar, basta nag submit lang daw po ng birth cert at ung kakilala na ng magulang ng girl ung nag asikaso. Online scammer at online sex slave po ung wife nya dati. Pwede po bang maging grounds ung kawalan ng marriage license at ung act ng dating wife nya for void ng marriage nila? Salamat po sa sagot.

first, take a look at his marriage contract to see if a marriage license is indicated. if none, and it can be proved that he was not qualified for exemption then there can be a basis for annulment

I have a court order issued to me after I won the annulemnt case I filed against my now ex husband. The court order says I have full custody of my 2 minor children and that the father should give 10k for each child every month until they finish their education. How do I go about this court order so my ex will be notified that the court is ordering him to give support. I cannot afford to pay a lawyer as I am a solo parent earning a menial income and supporting 2 kids. But I want the law to be upheld and to be respected especially by men who refuse to give their kids a decent living. Please let me know how to go about this and how could I get legal help.

go to the court and talk to the clerk of court about filing a motion for execution

Thank you very much for your prompt advise. Afterthe finality and the decision of my annullment which gave me a court decision to ask for child support, whose duty is it to file or to inform me that I have to file for motion for excution? Is it the lawyer, the clerk of court or is it myself? However, I have no information that I need to do such procedure.
Note: my lawyer is parang DA (pro bono) I forgot the right term, po.

Salamat po sa pagsagot. Paano po kung meron daw binigay ng parang reference number before ung kasal nila? Valid po ba un na marriage license? And Natatakot po kame bka pag nagfile ng annulment ung kalive in ko ngayon eh baliktarin po kame at sampahan din kame ng kaso dahil may anak na po kame. Salamat po sa payo nyo.

im married since 2008 sa palawan cityhall, with 2 kids. april 2012 church wedding. my husband is seaman and im a nurse. since oct 2012 im here in saudi working and he is on board on ship at nkkauwe ng 3months vcation. since we got married theres arguments and sometimes physical abuse,nabubugbog nya ko khit buntis aq s mga anak ko. since then also puro away n kami khit mgkalayo n kmi ngayon because of our work. unexpectedly im now in love with jordanian nationality here sa work ko and he wants us to marry here in saudi and i will convert to muslim. i fall out of love on my husband.
anu po ba i uunlegalize nmin n marriage iyong court or church? pgnag muslim po ba aq invalid npo ba marriage nmin as christians? pede po ba aq mgpkasal dto s saudi and be muslim or iunlegalize ko muna marriage nmin pgdting ko s pinas? thank u po

You have to ask the court to annul your marriage in the Philippines first. If the disagreements amount to psychological incapacity, then you have a ground.

I am green card holder and works in the US. I want to file an annulment against my husband who has presently has custody of my child and also depriving me of communicating to her.
What can I do to compel my husband to have rights over my child?

Kung gaano katagal will depend on a lot of factors-- what ground will be used, availability of evidence, whether contested or not, and where the case will be filed

Yes you can file for declaration of nullity and child custody. It does not matter if your child is 11yrs old. What matters is that you can prove that the best interest of the child will be best served if you have custody of her
