Hi Attorneys,

My grandmother died last year and left 3 properties.

Property A co-owners are:
Grandmother - 7/12 share
Sibling A - 1/12
Sibling B - 1/12
Sibling C - 1/12
Sibling D - 1/12
Sibling E - 1/12

Property B solely owned by Grandmother (but occupied by informal settlers)

Property C co-owned by Grandmother (partition unknown also occupied by informal settlers)

All the siblings are only interested to Property A because of its high market value but could not agree to the partition.

Sibling B and C had executed waiver of rights in favor of Sibling A. Sibling B and C are waiving their 1/12 shares and share to be inherited from the mother's 7/12 in favor of Sibling A.

Therefore, Sibling A should have 3/5 share while Sibling D and E will have 1/5 share each.

However, Sibling D and E does not agree that they will only get 1/5.

Please advise.

1) We are filing judicial partition for Property A only. Is this permitted in court? excluding property B and C.

2) What are the chances that Sibling A will get the 3/5 share given that there is waiver from her two other sibling (B and C)?

3) What are the arguments or defense the opposing siblings (D and E) could make up?

I have a question po Atty.

Meron po naiwan na property ang lolo ko around 1500+ sqm. Nakatitle pa po ito sa Parents na nya na Decease napo. Died na din po ang lolo ko. So 4 na magkakapatid po ang lolo ko at meron 360+ sqm. na kabahagi ang lolo ko na hindi pa nalipat sa knya. Bale mapupunta na po ito sa Lola ko at mga anak nya? Ang pagkakaalam kopo 50% nito ay automatic sa lola ko. Paano po ba ang procedure ng hatiian nito? At another 50% of 362 sqm sa 5 magkakapatid. Ngayun po yung 3 magkakapatid decided to sell their part to me. Yung 2 po ayaw ibenta kahit napakaliit nalang po ng sukat na matitira sa knila. Ang estimate kopo kong sa 362 sqm half sa lola ko 181 sqm sa lola at 181 sa 5 magkakapatid divide 5 is 36.2, Bale 72.4 sqm po ang ayw ibenta. Naguguluhan po ako kong papaano ko ipaprocess ang pagpapatitle kong ayaw pa nila pa ibenta ung maliit na mawawala. Anu po ba step by step ko gagawin dito . Maraming salamat po.

Atty good day po meron po ako another question:

Bale meron po ako client na Nagbebenta ng property nya and nahanapan kopo sya ng buyer. Malinaw po usapan namin sa mga taxes kong sinu ang dapat magbyad. Tapos npo negoatiation then nakuha nadin po ng seller ang down ng buyer later on po nung papasign ko yung asawa sa contract sabi po nung lalaki patay na. So nagulat po ako kase ang alam kopo dadaan sya sa Extra Judicial of estate.. Ang tanung kopo atty. Alin alin ang property na kailangan ideclare ng Seller yun po ba nakapangalan lang sa knila magasawa? Or pwede po ba na di na dumaan sa EJS kase po okey naman daw title as per my client. Paano po way na hindi na mag EJS? Thanks po and Godbless
