An NTE is a due process documents that you will need to explain only.
It's your supervisor responsibility to issue one if he/she thinks you will need to be issued.
You can not question his/her power to do so.
Just answer the NTE and that's it.

What if there were numerous NTEs issued throughout a span of 3 months, all of which was deemed baseless or immaterial? unjust vexation?
