Hi there. I need little advise about what to do. I lend my officemate P5000.00 and we have a contract stated she needs to pay P1000 every 15days for 3months (P5000+P1000 interest) Also noted in our contract that in case she fails to pay on time our contract will automatically be terminated. At first, pinalalagpas ko kahit overdue na pero after paying P2000.00 di na siya pumasok sa office. Di na rin niya ko kinausap. Di ko na rin siya macontact through her mobile. Valid ba na magfile na ko ng estafa case? and, can I file a complaint against her to NBI? I have her photcopies of IDs.

failure to pay a debt is not a crime. i do not believe a criminal charge will prosper.

i recommend you file small claims case instead. rules on sc.judiciary.gov.ph. good luck.

ano po ang dapat gawin kapag kinasuhan ka ng estafa at bp 22 bouncing checks law if nagbabayad at naghuhulog ka naman after nag bounced ung mga tseke

my suggestion would be to enter into an amicable settlement with the complainant because you appear to be in a better financial situation now.

if that fails, allege your payments as your defense. were you informed in writing that the checks were dishonored?

no...amicable settlement failed because masyadong mabigat hinihingi niya...i wasnt informed in writing that the checks were dishonored...and the fact that im paying..i have proof of evidence like deposit slips...will i be liable for estafa?i am confused...natatakot po ako..this is my first time eh and sabi ng atty ko maghanda raw me ng pagpiyansa if lumabas na ung resolution...oct 16 po un

janwell, if you have your own atty, then it is better these inquiries are addressed to him. he has better understanding of your case.
