Vehicular Accident

good day.. mayron lang po sana ako itatanong regarding sa isang vehicular accident involving my truck.. ito po yung facts ng events: collision at intersection between motorcycle and truck.. truck travelling from south to north (complete and valid registration and drivers license) collided to motorcycle travelling from west to east (expired drivers license, not wearing helmet, no plate number at for registration lang nakalagay).. nakalagay sa police report, 20ft. brakemark ng truck at 10ft. nadrag ang motor.. tinulungan po ang naaksidente sa hospital but unfortunately after 2days, namatay po yung driver ng motor.. ngayon nagfile po ang kaanak ng namatay ng criminal at civil case for the reason na mabilis daw ang truck dahil sa brakemark at dragmark, ano po ba ang pananagutan ng driver at owner ng truck since xpired ang drivers license ng motor, wla siyang helmet at wla sya sa right way? salamat po sa magbibigay ng xpert opinion

Wag niyo po masyado gamitin depensa yung expired license at walamg helemt. Ang punto po dito kung sino po ang cause ng accident ito po ay mga evidentiary in nature at malalaman during court proceedings

Yung driver po pwede makulong at magbayad damages. Kung d po makabayad yung driver ang employer ang magbabayad.

According to the supreme court, driving without a proper license is a violation of traffic regulation. Under Article 2185 of the Civil Code, the legal presumption of negligence arises if at the time of the mishap, a person was violating any traffic regulation. However, a causal connection must exist between the injury received and the violation of the traffic regulation. It must be proven that the violation of the traffic regulation was the proximate or legal cause of the injury or that it substantially contributed thereto. Negligence, consisting in whole or in part, of violation of law, like any other negligence, is without legal consequence unless it is a contributing cause of the injury

unlicensed person driving a vehicle was already in violation of traffic regulation.. hnd po ba kapag wla kang drivers license it means wla kang right to move a vehicle at gumamit sa government roads? hnd dn po ba kapag wlang license, automatic na po yun na wla kang right of way? kc yung right of way ay previlege po yan sa license driver.. pakienlighten lang po.. salamat

yung walang helmet baka pwede pa yung hindi gamitin pero yung walang license parang hindi ako makapaniwala na mas mabigat pa ang ibang violation tulad ng overspeeding at right of way.. according sa hpg and lto na napagtanungan ko, kung walang kang license, wala kang right na gumamit ng governmnt roads at wala ka ding right na imove yung vehicle.. by that, kahit 10kph lang yung takbo mo at hindi overspeeding, violation pa rin yun kc wla ka ngang right imove ang vehicle.. and kahit nasa lane ka pa nagdrive, violation pa rin yun kc nga wala ka ngang right gumamit ng govt. roads.. so yung driving w/out license, mayron po ba yung causal connection in the injury received? i think yes..
