Hi, I'm new here in your forum.

I'm 26 y/o and just got married last July 21, 2013. I'm a single parent since I'm 21 and I had no communication with her biological father and even in birth certificate nor baptismal I haven't included her father's name.

Now my hubby wants to adopt my daughter since she's already 5 years old and will be schooling soon.

Where to start and what are the process in adopting my daughter.

Please revert soonest and your help is greatly appreciated.

Arresto Menor

Art. 185. Husband and wife must jointly adopt, except in the following cases:
(1) When one spouse seeks to adopt his own illegitimate child; or
(2) When one spouse seeks to adopt the legitimate child of the other.

(a) When one spouse seeks to adopt her own illegitimate child.

EXAMPLE: A husband is married to a girl who has an ILLEGITIMATE child. If the wife wants to adopt said child, must here husband also adopt the child?

Answer: NO, because the child is illegitimate. Of course, if the husband wants to do so, he may join in the adoption.
