Hi Atty!

My brother is married, right now he has ann affair with his co employer. His company tells him that he is subject for termination, but based on their code of conducts is:

Section 9. Conduct of grossly indecent gestures/actions; Engaging in highly scandalous conduct which may tend to disrupt employee’s productivity and that of his/her co employees

also

Section 10. Manager and staff within the same department or engaged in the same nature of work having a romantic/sexual/illicit relationship (one of the parties shall resign or be transferred)

both are subject for dismissal. Does it mean he can be terminated?
