Arresto Menor

Yun kaibigan ko po nag ojt as welder. After ng ojt nya inaccept sya ng company, employee as office staff since na may may itsura kc at nakakagiliwan naregular sya. After all parang pinersonal sya ng om at nakainitan, dinemote sya from office staff to hardware personnel inshort balik sa welder. Ang question po pwede po bang mangyari na idemote sya kahit alam nyang wala syang ginawang mali? Binabaan sya ng memo from office staff to hardware personnel ng hindi sya kinausap at ipinaalam kung ano mga mali nya basta nakalagay lng sa memo na demoted sya due to unsatisfactory performance? Kung welder po ang background nya sa ojt nya sapat ba yun na dun din sya ibalik gayong employee sya as office staff ang contract na pinirmahan?

This is a case of unlawful constructive dismissal. Demotion, especially kung may diminution o pagbawas sa benefits, ay para naring pagtanggal sa'yo sa trabaho.

Maaaring mag-demote ang employer kung may basehan ito (eg. habitual tardiness or company policy). Kung may evaluation nga at binigyan sya ng unsatisfactory performance, dapat isubstantiate ito ng employer at bigyan siya ng oportunidad na depensahan ang sarili nya. This is part of due process. There should be two notices: (1) notice of the ground for termination (at hayaan siyang sumagot at magpaliwanag); (2) notice of termination o ang desisyon ng kumpanya after hearing (or at least an opportunity to be heard).

Dito, in bad faith yung OM at mukhang may ibang motibo at wala talagang basehan ang demotion.
