Sana po matulungan nyo ako sa aking concern.

What happened was during our Annual Physical Exam I was incorrectly diagnosed with a serious medical illness (PTB Bilateral).

This result was due to negligence on the part of the person who performed my XRAY. Sabi nya sakin wag ko na daw itali ang buhok ko (I have this long dreadlocks). Then he just took my Xray and later on na lumabas na may TB daw ako.. (because of the illusion na nagawa ng buhok ko)

So I went to a doctor to have the diagnosis checked. I even insisted to have another chest xray. But the doctor refused instead she quickly handed over what medication should I take. As per that doctor I am already on the 3rd stage by just looking over at the xray.

So in short she did not perform any other test. Like Sputum, Skin Test, Xray

On my end. I am confused worried and afraid. So I immediately took the medicine the next day.

My immediate family went to the hospital to have their xray done.. I told the doctor that I was diagnosed with PTB. Then the doctor told me to do a Sputum test so that I can have free medical assistance (DOTS)

After few days Sputum result came as NEGATIVE. I went to see the doctor and they performed 2 xray and skin test. All results are NEGATIVE.


On this scenario, what's the best legal approach that I need to do? Would this fall under Medical Malpractice/Negligence?
