ADULTERY: caught through facebook

Hi, thank you for providing the public a site which gives free legal advice.

I am an OFW and now in dubai as of the moment, i just found recently that my wife is having an affair with another man in the philippines, i have managed to open her facebook account and that is where i caught her that she is having an affair. i have read the threaded message that, they are seeing each other and having sex. i called and confronted her about what i have discovered and she denied everything, she is saying that she is just fooling around with the guy and that they don't have any sexual relationship, but after 2 days i was already calm and asked her if she did have sexual relationship with guy, and she admitted.

my question is can i file for an adultery case against her? using that facebook message as an evidence?

if yes, what is the legal action i would take against her?
can i have a custody with my kids? my kids are 6, 3 and 2 yrs old.

and how long can i file a case against her? i am due for vacation on december and i plan to file a case that time when i arrive in the philippines...

I am not sure about the evidence you have if it is just from FB, although she admitted it to you, she can easily deny it if it is not in writing and adultery is not easy to prove as you have to prove that you caught her in the act having sex with other man. With regards to your children's custody since they are only 6, 3 and 2 yrs old, your wife has an automatic custody. And if you open a case against her your children will end up with DSWD not with anyone you assign to leave them with. Think over it, infidelity is not a ground for an annulment, do some more research, what you could do is to approach a lawyer who can advice you what is the best thing to do!
