Hello,

I would like to consult about our rights to our leaves.
I understand that companies are only compelled to provide 5 days of leaves. However, when I signed my contract, I was promised to have 15 days of leaves (VL/SL). Now, management is not letting me consume all my leaves saying that it is their discretion to approve them or not.
They say that although it's mentioned that we have 15 days of leave credits it doesn't mean that we can enjoy them all. I have been with the company for almost 3 years now and I can barely use 1/2 of what is due to me yearly. Plus they are not even converting the remaining credits to cash. Do I have the right to fight for it? Can I sue the company for not giving me what was promised?

Thank you,

i believe there is no clear ruling on this. i think it is still within the management prerogative to disapprove VLs if there is a valid business purpose.

there is no law that requires monetization except for the 5 days SIL, and i also believe it is valid for the company to consider your first 5 used days of leave as the SIL.
