Advice naman po nagtransfer kami ng titulo ng lupa sa pangalan ko at sa kapatid ko. Im married at ang husband ko ay may anak sa pagkabinata. Sa titulo ng lupa namin inilagay din nila ang pangalan ng asawa ko.

Gusto namin ipatanggal ang name ng husband ko sa titulo for our own security. Possible po ba namin gawin iyon? or kailangan ilagay na single ako dun sa titulo?

Malaki na ang naubos namin sa pagpapatransfer ng titulo. Malaki pa rin po ba ang aabutin ng pagpapayos nun? kaparehas ng halaga ng ginastos namin sa una? Last question po kung sakali, may habol po ba ang mga anak ng mister ko sa lupa naming magapatid?

smiley, please explain how you acquired the property. is this through inheritance? if so, this is your separate property and his son will not have any right to it.

do not be putting false statements on a public document. you can get into a lot of trouble doing that.

Actually atty, before yung 1/2 ng lupa nakapangalan sa name ng parents ko and the other half sa kapatid ng mother ko. Eventually binenta na din sa amin yung kalahati pa ng lupa. Yung half na iyon ako na ang bumili at sa pangalan ko na iyon.

Meaning ba nun atty doon sa half na nabili kong lupa, doon may habol ang mga anak ng mister ko? and in the future kung bibili muli ako ng lupa magkakaproblema pa rin ako sa kanila? Wala na po ba akong ibang paraan para hindi na sila magkaroon ng habol sa mga ipinupundar ko?

the presumption is that the portion you purchased is considered conjugal property but the illegitimate son will have a right over the property when your husband dies.

this presumption can be rebutted if you can show that the property was purchased with your separate property. another way is to have your conjugal properties undergo judicial separation so that your property will be your own.

If I may add..assuming your husband died, half of this land will be included in his estate..thus his children, including the illegitimate ones will have the right over the property..

however the right of the illegitimate child will be less to that of the legitimate ones and the surviving spouse.
As the law provides a smaller share for illegitimate children in so far as their rights to enherit from their parents.

I suggest that you already give the portion to your brother( by donation or by sale). Though this might require you to incur some expenses this may save you from any trouble or dispute arising from the illegitimate child of your husband. Thus, you'll be avoiding any suit or litigation in court.

Atty pwede ba akong magdonate ng property sa kapatid or dapat sa anak ko lang? And in my situation wala kaming anak ng mister ko.

you can donate to anyone, just note that you will have to pay donor's tax, and run the risk that the donee will be given the legal rights to dispose the property as his own.

Depending what state you live, but the owner must sign a deed on the property the new owner. A receiver wants to act a title search to ensure the property is free of liens and judgments and other issues that may cloud title...

Hi atty. pls help me. I used to have a business partner and we bought a property in batangas the title is under my name but the documents are with her. I told her that we should divide the property but she wanted the smaller portion to be given to me. I told her that it should be divided equally. how can i get hold of the title its under my name but its her, can i request it in the municipality bec she might sell it without my knowledge. thanks pls help

others would have the title declared lost and petition the court to have another issued. that can be a dangerous short cut if it can be proven that you know where the title is.

another way is to file a petition in court to compel the business partner to return the title.

Hi Attorney!

Gusto ko pong itanong sa inyo ang lahat tungkol sa INHERITANCE at Rights naming mga apo sa lupang pag-aari ng LOLO at LOLA ko.

My lolo(father side)died a couple of years ago tapos my will na siya sa lahat niyang 7 na ANAK(including my FATHER) ang magmamana sa LUPA na pag aari nya.

My Lola still has all the TITLEs, WILLs and other legal documents of the PROPERTY cuz she's malakas pa naman.

Ang Tatay ko died 12 years ago, so everytime nagtitipon-tipon mga UNCLES at AUNTIE ko ay pinapatawag nila yung PANGANAY naming kapatid na lalaki para pag-uusapan ang tungkol sa LUPA na mamanahin nila at ng TATAY ko. Since wala na ang TATAY ko, so sa aming 8 na magkakapatid at nanay namin ang magmamana ng MAMANAHIN ng TATAY ko.

Ngayon po, Sa daming beses napo nag titipon mga TITO at AUNTIE ko pati narin yung panganay naming kapatid na LALAKI, para pag-usapan kung saan ang lupa nilang gustong aangkinin, nakapagpili napo sila ng gusto nilang angkinin na lupa at ang mga tira2x na lupa nalang yung mapupunta sa aming magkakapatid na minana ng TATAY ko.

Lahat po ng piniling lupain na inangkin ng TITO at AUNTIE ko, lahat po pinili nila ay may mga legal na documento like LAND TITLES. Tapos yung natirang lupa na para sa TATAY ko, may 10 Hectares na LUPA na walang TITLE, so hindi nila pinili at inangkin dahil cguro hindi nila gusto mahirapan sa mahabang pagproseso sa pagkuha ng legal na documents para sa lupain nito kaya napunta nalang eto sa TATAY ko na yumao na. Ang lupa lang na minana ng TATAY ko ay yung lupa namin na may sukat na 15 Hectares.

So recently lang po, ang companyang APO Cement Corporation ay nagka interes na bilhin yung LUPAIN namin na 15-hecatares na may TITLE. Pero, nung nagkasakit yung LOLO ko at before siya namatay, isinanla ng LOLA ko ang TITLE ng LUPAIN na yun sa halagang 10,000 pesos para ipagamot ang LOLO ko.

So ngayon, pinatawag ng mga TITO ko ang panganay naming kapatid na LALAKI para pag-usapan ang lupain na pinagkakainteresang bilhin ng company ng APO CEMENT. Ngayon po, gusto nilang tubosin yung LAND TITLE na isinanla ng LOLA ko dahil nabalitaan din nila na GUSTO itong bilhin ng isang malaking companya.

Hindi pa po sumang-ayon yung kapatid ko naa tubosin nila yung TITLE gamit ng pera nila ng mga TITO ko. Nakatira kami sa City while yung mga tito ko sa probensya at malapit lang kung saan nakatira yung LOLA ko.

Hindi ko po alam kung anong mangyayari dahil malayo ang tinitirhan naming mga kapatid sa LOLA ko. I dont know if hindi talaga nila tinubos or tinubos na nila ang TITLE na isinanla cuz malapit din sila ng LOLA ko.


Ngayon po ito po ang aking mga katanungan:

1.) Since alam ng mga TITO ko na pinagkakainteresan bilhin ng company ang LUPAIN namin at ganun nga na gusto nilang tubosin ang TITLE gamit ang pera nila, posible bang ipagpalit nila yung lupa nilang inangkin sa lupa namin na pinagkakaintersang bilhin ng kompanya??? May posibleng gulo ba eto?



2.) Hindi po kami close sa panganay naming kapatid na LALAKI tapos siya pong parating pinatawag para pag usapan ang tungkol sa LUPAIN namin kahit na MATANDA na kaming lahat at may kanya-kanyang hanapbuhay. Mas AUTHORIZED ba yung kapatid ko sa lupa na MAMANAHIN namin lahat na magkakapatid? Wala pong trabaho ang panganany naming kapatid na LALAKI at isang tambay lamang, posible bang magagawa nya lahat anong gusto nyang gawin sa aming lupain na hindi namin nalalaman????


3:) Ano ano pong mga karapatan at kaya naming gawin naming ibang magkapatid para pigilan ang posibleng gulo na maidudulot nito?????
